Govt lacks planning, capability: CJP Nisar

ISLAMABAD: Chief Justice of Pakistan Mian Saqib Nisar on Monday remarked that the incumbent government lacks capability and planning to run operations.

During hearing of Banigala encroachment case, the CJP expressed displeasure over the delay in regularisation of the properties in the area.

Additional Attorney General presented the report on behalf of Capital Development Authority (CDA).

The CJP observed that the development authority may need more land to lay electricity cables and because a completely 'Naya Pakistan' is in the making you might also like to run underground railway.

The government need land for providing services to the residents, he added. If the CDA has no plan then it should regularise the buildings after due process.

The spokesperson of Survey General of Pakistan informed the court that the authority has completed the survey but has not received the payment from the concerned departments.

The CDA and ICT owe Rs3.42 million to the SGP, he further told the bench.

On this, the CJP directed the Additional Attorney General to make sure that the payment is released within a month.

نجی ٹی وی چینل دنیا نیوز کے مطابق چیف جسٹس ثاقب نثار کی سربراہی میں بنچ نے بنی گالہ میں بغیرمنصوبہ بندی تعمیرات سے متعلق کیس کی سماعت کی،چیف جسٹس پاکستان ثاقب نثار نے ریمارکس دیتے ہوئے کہا ہے کہ حکومت کے پاس اہلیت ہے،صلاحیت اورنہ ہی منصوبہ بندی،آپ نے علاقے میں سڑکیں اورسیوریج نظام بناناہے۔

چیف جسٹس نے ایڈیشنل اٹارنی جنرل سے مکالمہ کرتے ہوئے کہا کہ سڑکوں اورسیوریج نظام کیلئے آپ کوزمین چاہئے،ممکن ہے زیرزمین بجلی کی لائنزبچھاناپڑیں،اس کیلئے بھی زمین چاہئے،نیاپاکستان بن رہاہے،ممکن ہے آپ زیرزمین ٹرین بھی چلاناچاہیں،بہتریہی ہے پرانی تعمیرات کوریگولرائز کردیں،سی ڈی اے نے ابھی تک کوئی پلان جمع نہیں کرایا۔

چیف جسٹس نے کہاکہ بنی گالہ کومنصوبہ بندی کے تحت ڈویلپ کرناہے توتعمیرات خریدناپڑیں گی،بغیرمنصوبہ بندی تعمیرات کرنے والے مالکان کوازالہ اداکرناپڑےگا،ریگولرائزیشن کیلئے مالکان کو پیسے تودیناپڑیں گے،ایڈیشنل اٹارنی جنرل نے کہا کہ 1960 کے نقشے کے مطابق زون 4 میں سڑکیں ہیں۔

چیف جسٹس پاکستان نے کہا کہ اگرنیاشہر بناناچاہتے ہیں توسی ڈی اےزمین حاصل کرے،مفادعامہ کی درخواستیں لوگوں کی سہولت کیلئے سنتے ہیں،عائشہ حامد ایڈووکیٹ نے کہا کہ پہلے سے مقیم افرادکوزمین ورثے میں ملی،برسوں سے مقیم افرادکوریگولرائزیشن کیلئے فیس کانہیں کہاجاسکتا۔

چیف جسٹس پاکستا ن نے کہا کہ سی ڈی اے آج کل عدالتی حکم کی آڑمیں لوٹ مارکررہا ہے،عدالتی احکامات سے سی ڈی اے کوطاقت ملی ہے،چیف جسٹس ثاقب نثار نے کہا کہ سی ڈی اے طاقت کے نشے میں جھوم رہا ہے،جس کے بارے میں حکم نہیں دیاوہاں بھی جاکرپیسے مانگے جارہے ہیں،چیف جسٹس نے کہا کہ عدالت نے ریگولرائزیشن فیس 5 سے کم کرکے 2.5 فیصدکردی،سی ڈی اے بہت امیرہوگیا ہے۔

I can understand how criticizing Shariff khandaan's way of work was taken personally...PTI is open to and welcomes constructive criticism to improve themselves...

Here CJP is also talking to CDA and giving suggestions...this is how a govt should work....give suggestions and constructive criticism to improve the nation! Not cry over it and start claiming my family came from india we were oppressed and the typical jargon we used to hear following ANY form of criticism in previous govt...

hmmm i would say thats a bit unfair statement. Th incumbent government has only been in power for what a couple of months now. Yes it has looked all over the place and yes the performance is not upto the mark but we must also understand that it inherited some messy problems and a country which was also all over the place and many problems required solutions a day after their office. In these last few months its been more than a few crises. to say that it lacks planning or capability is simply too soon. we need to give them atleast half their tenure...

This CJP is what IK used to be - full of chutiyapa and dialogue with nothing to back it up. He needs to get his own house in order before pointing fingers at anyone else - just look at the state of courts in Pakistan and all the cases pending. I would like to ask CJP that he has been in his seat for two years and what has he done for reforming and restructuring the judiciary rife with corruption and incompetence. I think CJP has done a good job in the past, dealing with the sensitive issues of the country but if he keeps getting himself in the middle of political nay-saying and oversteping his bounds, he is only losing that massive respect he's gained over the past few years. We all know the govt.'s have issues dealing with stuff but that doesn't mean you, a main pillar of the country start throwing insults at the other main pillar of the country like its no big deal.

In short, he should keep his mouth shut and strictly do whats required of him as a Chief Justice and continue providing justice for the nation and not ruin the image he has created for himself.
