Former MiG-21 pilot sues Indian government for breaching constitutional right to life

The Delhi High Court on 16 July directed India's federal government to provide by October a list of all MiG-21 crashes in response to a petition filed by an Indian Air Force (IAF) fighter pilot who is demanding that the Russian-designed combat aircraft be scrapped on safety grounds.

In his appeal to the Delhi High Court, Wing Commander Sanjeet Singh Kaila, who survived a MiG-21 crash during a routine sortie in 2005, declared that flying a MiG-21 "was a violation of the fundamental right to life, especially the right to work in a safe environment" in consonance with Article 21 of the Indian Constitution.

It is quite expected from the person who was flying the flying coffin for India...Indian GOV should a least the value of those dedicated fighter who put their life at risk and fly out these planes just for the sake of the country....

I am not expert on this but Armed force personnel demanding the right to work in safe environment sounds a little strange

I know it does sound strange but when you think about it, you would expect that your employer provides you with a safe and sound equipment to do your duty. I think this guy is very brave, he is asking the basic q that if something happens once then it is an accident 2x it is an oversight 3rd time then it is an issue, a hundred odd times then it is not fit and proper for use. Hence he is right. It is the same issue I have with Pak army sending soldiers in tin cans to fight the TTP, these things are not fit for purpose and the PA is derelict in its duty to the safety of it's men and women.

I think kins of a british army guy got compensation for death due to lack of facility or something... in afganistan.

Its not good for the moral and discipline of the armed forces...if such petitions are acknowledged then every 2nd soldier can go to the court with a new excuse..

civilan courts works outside forces, they give justice many times when forces dont.

If Rahul Gandhi was supposed to fly one I am sure GoI would have even requested for F22. Common Citizens life donot value much in Supa dupa India.

Bro this is armed forces...the 1 should be ready and brave enough to face the reality...no country wants their planes to crash and to lose a man exceptionally better then an ordinary guy..if india is unable to replace its aging fighters due to any reason it may be...it does not give right to any of its personal to take her in court...there are many difficult times a soldier had to fight and give his life not because of his own fault but wrong planning or maybe lack of equipment but this is how it is cant be perfect..

Even if the armed forces do not come under civil courts they should abide by the court decision for well being of their own personnel. MIG 21 have served their useful purpose all these years and have become obsolete. They should be retired and immediately replaced by LCA Tejas.
