Faisal Raza Abidi demands CJ

ISLAMABAD: Pakistan People’s Party (PPP) stalwart, Senator Faisal Raza Abidi on Thursday demanded Chief Justice Iftikhar Muhammad Chaudhry to resign from his post for misusing authority, DawnNews reported.

Abidi tried to stage a sit-in when he was not allowed to speak on the subject during the Senate session on Thursday.

On chief whip’s intrusion, the PPP leader decided to sit on his allotted seat.

Criticizing the chief justice for allegedly using the letter head of the Supreme Court for his family’s business, Abidi said that Justice Chaudhry is guilty of violating the constitution.

He accused the chief justice of the apex court of excessively using the power of taking suo moto actions and against the court’s norms issued undue and excessive injunctions.

Abidi demanded Justice Tasaduq Jilani to call a meeting of the Supreme Judicial Council over the issue.

The senator, on the occasion, handed few important documents to the chair.

Earlier in August, Faisal Raza Abidi had hurled serious allegations against judges at a press conference, claiming “a judicial martial-law has been imposed in the country.”

The firebrand PPP senator had made allegations of prejudice against Chief Justice Chaudhry, and had demanded resignations of the reinstated judges who had taken oaths under the Provisional Constitutional Order (PCO).

Moreover, he alleged the chief justice’s son, Arsalan Iftikhar, of indulging in financial impropriety. Abidi also claimed that PPP stalwart Aitzaz Ahsan had brought to the CJ’s attention that Arsalan’s bank accounts carried the address of the CJ’s official residence.

The senator said his party was being targeted by the court while cases against the PPP’s opponents had been granted stay orders.

Later that month, the PPP dissociated itself from Abidi’s anti-judiciary rhetoric, issuing him a notice for violating party discipline.

Senator Faisal Raza Abidi of the Pakistan Peoples Party has been an outspoken critic of the Judicial bias of the current PCO judges of the Supreme Court of Pakistan. He has consistently exposed the judicial bias in favour of ****** militant leaders like Malik Ishaq (leader of LeJ/ASWJ) and Hafiz Saeed (LeT/JuD). Senator Abidi’s biggest sin has been to expose the massive corruption, cronyism and extremist tilt of Pakistan’s PCO Supreme Court judges. He has painstakingly gathered the evidence and made his case against the Judiciary based on the Constitution and the Law.

After highlighting specific instances of how the Chief Justice self-admittedly took a massive loan from the House Building Finance Corporation to celebrate his corrupt son’s wedding, Pakistan’s so-called “independant” media was promptly gagged by Chaudhry’s henchman, the Chief Registrar of the Supreme Court.

Instead of taking a stand, the otherwise self-righteous and loud media buckled and did not provide Senator Abidi his Constitutional right to critisize Supreme Court judgements and point out the double standards and growing corruption allegations surrounding the Chief Justice and his corrupt son, Arsalan Iftikhar.

In his interview on Soch Pakistan (ARY October 26, 2012), Senator Faisal Raza Abidi provided the legal and Constitutional basis for his valid criticism and exposure of the current PCO Chief Justice. Ironically, the decision by the Islamabad High Court (by a Judge who was a Jamaat-e-Islami electoral candidate in 2002!) to quell criticism of the Judiciary is in direct opposition to the Standard Operating Procedure laid out by Chaudhry Iftikhar himself!

Islamabad, Aug 14 (www.pakdestiny.com) PPP Senator Faisal Raza Abidi has accused Chief Justice Iftikhar Chaudhry of taking ‘loan’ from the House Building Finance Corporation (HBF) ‘illegally’ for holding a wallima ceremony of his son Arsalan, requesting his fellow 16 judges of the SC to throw him out as he is ‘jahanmi’ for telling a lie under oath.
In a talk show on Dunya TV with Muhammad Malik on Aug 13, Abidi said he would file a reference against the CJ and exposed his ‘corruption and lies’ before the people of Pakistan.

He said at the house of the CJ, a private company was being run earning millions illegally. “How Arslan become owner of Rs900 million in three years, where was his father,” he said.

He said the CJ also set free Malik Ishaq accused of killing 130 people and was more interested in taking suo motu in Atiqa Odhu case for ‘some special reason’.

He said the media houses became billionaire by holding media trial of of President Zardari in Swiss cases. The media also held trial of Abdul Qadir, Musa Gilani and Moonis Elahi but afraid of talking about Arsalan corruption, he said.
Abidi said he was ready to go to jail for exposing the CJ and his son’s corruption. “I will not go alone I will also take this ‘nasoor’ (dark blot) with me,” he said.

ARY files reply to PEMRA's notice

ARY Communications has filed reply to PEMRA's (Pakistan Electronic Media Regulating Authority) notice in contempt of court case which directs to produce Senator Faisal Raza Abidi as a witness in the case.

Barrister Aitizaz Ahsan filed ARY Communications' reply to PEMRA through barrister Gohar Ali Khan.

In its reply, ARY communications say that the Supreme Judicial itself has declared that complaint against the violation of ethical conduct by any judge could be brought to the notice of the Council also thru electronic and print media reports.

Thus, the reply says, if a person brings out violation of ethical conduct against any judge it could not be called contempt of court or affront of the judiciary.

The reply demands summoning the host of the program Faisal Raza Abidi as the witness of court or the defense to unearth the facts. There should be a transparent trial to decide whether the matters that he presented was true of false, the reply says.

It is further said in the reply that PEMRA's show cause notice is totally against the freedom of expression and access to information by the people. The action against ARY Communications is an attempt at endangering the livelihood of 1,500 employees, the reply says.

ARY NEWS played front-line role in the movement for the restoration of the judiciary. ARY NEWS furnished the basic evidences in the case, in which high officials were convicted for contempt of the court, to debase Chief Justice Iftikhar Mohammad. Chaudhary, the reply says.

The action against ARY is a clear violation of Articles 10, 4-A, 18, 25, 19, 204 and 209 of the Constitution.

This is again Abidi barking and nothing else. Notice how he discusses these allegations on media but never go to appropriate forum. I remember in a talk show some time back where the host tells Abidi that if you have such concrete proofs then why don't you go and file reference in supreme judicial council, to which Abidi had no reply except "bla bla bla there is no point going in SJC when judges there favour SJC". The host replied that it doesn't matter as to who favours whom because at least you should fulfill your responsibility so no one can point a finger at you and if justice is not delivered then every one will see this. Then the anchor says that I pray that you show some courage and go to president house and file reference against Iftikhar Chaudhry.

By the way since Abidi looks your favourite, why don't you ask him about when he is going to commit suicide which he promised in talk show? It will make every one happy, trust me.

ISLAMABAD, Aug 5: Firebrand Senator Faisal Raza Abidi distributed at a press conference here on Sunday copies of the bank statements of a company, ‘F&A Enterprises’, allegedly owned by Arsalan Iftikhar Chaudhry, son of the chief justice, carrying the address of his official residence.

The senator, who was accompanied by some office-bearers of the People’s Lawyers’ Forum, alleged that a transaction of Rs10 million had taken place through Silkbank (Account 011041739201) in the name of an information technology company owned by Arsalan Iftikhar and the bank statement showed the address: “F & A Enterprises, Chief Justice House, Islamabad”. He also
distributed a document showing Arsalan Iftikhar’s signature as the chief executive of the company.

Senator Abidi claimed that PPP stalwart Chaudhry Aitzaz Ahsan had not only informed the chief justice about his son’s links with property tycoon Malik Riaz, but had also brought to his notice that Arsalan’s bank accounts carried the address of CJ’s official residence.

The senator announced that he would soon visit London and Dubai to collect more evidence against Arsalan Iftikhar and to prove how he had started transferring money in the name of his maternal uncle.

He said he would hold another news conference before Eid to present more details about contracts awarded to the IT company allegedly owned by Arsalan Iftikhar.

He said the person who used to do a job some five years back now owned billions of rupees.

The PPP senator, who said he was speaking in his personal capacity and as a member of parliament, made a scathing attack on the chief justice and judges and said he was willing to be summoned by the apex court over his remarks.

Criticising the Supreme Court for nullifying the recently-passed contempt of court law, the senator termed it part of a plan to pitch two state institutions against each other.

Senator Abidi said that while contempt cases against a number of people, including PPP leaders Babar Awan, Sharjeel Memon and Taj Haider, were pending the court had hurriedly convicted a prime minister and sent him home.

The senator disclosed that former Inter-Service Intelligence (ISI) chief Shuja Pasha had said during an in-camera briefing to parliament that the army had arrested 922 Taliban and terrorists red-handed during military operations and all of them had
been released by courts.

Accusing the judiciary of showing bias, Senator Abidi showed a copy of a verdict (PLD 2000) of a Supreme Court bench that included Chief Justice Chaudhry which had validated the 1999 military coup of Gen Musharraf on the basis of allegations that
former prime minister Nawaz Sharif was involved in Rs6 billion money laundering. He asked why the court was not taking any step to bring this money back to the national exchequer and was only interested in Rs1.5bn allegedly lying in the Swiss accounts
of President Asif Zardari.

He said there were 2.1 million cases pending in the courts when the present judges were restored and now the number had increased to over 2.3 million.

He clarified that he was addressing the press conference in his personal capacity as a member of parliament.

PARTY VERSION: When contacted, Presidential spokesman Farhatullah Babar said he had not followed the news conference and, therefore, could not comment.

However, he said, the PPP had already presented its viewpoint on the SC judgment and the role of judiciary through official handouts. He said despite having reservations the PPP had always used decent language while discussing the role of the
judiciary.
