Consular access can't be rejected. If it is, it sets a bad precedent. Any country can pick up an citizen and deny him consular access.

Yes it can be rejected. That is what bilateral agreement between Pakistan and India says

Basically ICJ questioned Pakistani military courts and its inhuman procedures.
Secondly ICJ did not agree to the way Pakistan conducted the trial.
Third ICJ pointed out that Pakistan violated Viennna convention.
Fourth ICJ asked Pakistan to take back its decision to conduct a fresh trial as per Vienna convention providing consular access to Jadhav.

Yes surely this is feb 27 th moment where Indian Mig 21 chasing 3 F16, who were running away after a failed attempt to bomb Indian positions, shot down a PAF F16.

We are asked to review the case as per our own legal system.
If above 2 conditions are agreed that ICJ simply accepted Pakistan's instance that he is a terrorist otherwise he would have ordered to be released and returned back to India. Isnt it ?

Sorry, I should've been clearer. I was talking about the following points made by 'Jagrity Sablok' in his/her tweet. I'm asking about the following points:

1: Kulbhushan Jadhav is not coming home.

2: His judicial review will be done by Pakistan's Court system, not ICJ.

3: Death Sentence still stands.

4: Councillor access can be rejected under 2008 bilateral agreement.

5: Terrorism charges not annulled.

Justice have Prevailed??

I think that Arnab Goswami would declare or would have already declared this decision as a great victory for Bharat Mata, as most of the posters on this PDF are also implying.

I disagree. I have heard that he is so precious for us that he is being well taken care of. His life and health is far far more important for us than India.

The tweet is total non sense, may be ISPR twitter army.

The court clearly said

1) The death sentence do not stand.
2) Military courts not acceptable.
3) Consular access must be given.
4) Jadhav should not be tortured, he should be kept safe in Jail.

Lastly ICJ gave a trashing to Pakistan to start behaving like a responsible nation.

The wording is "the court has held that Pakistan is guilty of internationally wrongful acts of a continuing character and it must cease those acts."

Definitely a surprising day for Pakistan for sure.

It only given a chance to review death sentence (which Pakistan was giving anyways) and that too under Pakistani law and even that review can be done under military courts

He wasn’t a civilian. He was a military doing wars act despite both countries not being in official war situation.

Yes, but Pakistan is a signatory to the Vienna Convention, and it must abide by it as applicable.
