LAHORE: A deaf mute woman, who was allegedly raped on a Lahore-bound train near Samasatta (Bahawalpur) two days ago, had to undergo medical examination thrice.
‘S’, a mother of three, was travelling with her sister and brother-in-law to Lahore from Quetta by Akbar Bugti Express on Saturday night.
The woman told her relatives [through sign language] that she went to washroom where an unidentified man barged in and raped her.
Victim’s brother-in-law Ali Aqdus reported the matter to railway police and they checked all bogies of the train and arrested a man ‘K’, a sepoy in Punjab Regiment and posted in Chaman, Balochistan.
The Samasatta railway police later registered a rape case against the suspect on the complaint of victim’s brother-in-law.
The complainant told Dawn that they were travelling from Quetta to Lahore when a man raped his sister-in-law in the washroom of the train.
He said his sister-in-law reported the matter to his wife and they raised an alarm [in the train] while adding the railway police reached there and inquired about the incident.
He said his sister-in-law narrated the incident by using sign language and also pointed to the man who was sleeping in other bogie near the washroom.
He said the police arrested the man and also registered a case but he did not understand why the police had his sister-in-law medically examined thrice.
He said first [medical] examination was carried out in Bahawal Victoria Hospital, second in Multan and again the officials called them to Lahore for third examination.
He alleged that the policemen were not cooperating with them and dealing [with them] like they were suspects.
Samasatta SHO Malik Iqbal told this reporter that the army personnel had contacted them and sought custody of the suspect for trial under military laws.
He said they had sent samples of the suspect for DNA test.
To a query, he said they would hand over the suspect to the respective authorities.
The SHO said he did not know why the authorities carried out three medical examinations.
He said the police registered the case and after medical examination allowed the family to continue with their journey.

Well if true then I hope the cut his tool off for good. There should be no compromise for rapists no matter where

I hope the justice will be served and if the soldier is found guilty, the military court serves him proper sentence. There are many such cases which have not been open to media or public(even involving very high ranking officers) but the military have taken action against them quietly.

Who decides which case will go to civil court and which case will go to Islamic court.
The applicant can either pursue his/her case in Federal Shariat Court which will proceed the case according to the Islamic law. the applicant is also free to pursue the case according to the 1973 constitution of Pakistan in the more common courts such as session court, high court etc.

P.S: The federal Shariat Court is equal the High Court of Pakistan.

  • Register an FIR under section 376 (punishment for rape), at the nearest police station. Call 15 in case of a sexual assault. Please call 1043 if your complaint is not registered.
  • A female police officer, or a female family member of the victim must be present when the victim’s statement is being recorded.
  • Medical examination of the victim can only be done by a female registered medical practitioner only after obtaining consent from the victim. DNA and other forensic evidence will be collected during the examination.
  • On filing a complaint, an individual should expect the following code of conduct from the Punjab Police:
  • The Police is under an obligation to carry out their duties in accordance with the Constitution, law and democratic aspirations of the people of Pakistan.
  • Every Police Officer must carry out his duties with:
o Utmost honesty and integrity

o Fairness and impartiality

o Without any corruption

o Politeness and tolerance

o Minimum force, and in accordance with law

o Without acts of torture or other cruel, in-human, or degrading treatment or punishment

o Without regard for personal benefit

o Care to ensure confidentiality of information

Punishment for Rape:
  • Death or imprisonment of minimum ten years and maximum twenty-five years and a fine.
  • When rape is committed by two or more persons, each of them will be punished with death or imprisonment for life.
  • Of a minor or a person with mental or physical disability, will be punished with death or imprisonment for life and fine.
  • By a public servant, including a police officers, medical officers, or jailors, will be punished with death or imprisonment for life and fine.

Hope Indian law makers can implement the clause for minor and mental or physical disability in IPC.. ... as the victim has no fault of culprit having a special status.
