Day of reckoning arrives for Mush​

ISLAMABAD - Things may take an ugly turn for ex-president and dictator General Pervez Musharraf who has returned to the country about a fortnight ago from self-exile.

On Friday, he was served a double whammy. First his nomination papers for the National Assembly seat from Kasur were rejected by a returning officer and then the Supreme Court decided to hear petitions seeking his trial for treason under Article 6 of the Constitution for declaring an emergency in 2007.A three-member bench, headed by Chief Justice Iftikhar Muhammad Chaudhry, will on Monday hear a number of petitions asking for Musharraf to be put on trial for treason.On Friday, former president Lahore High Court Bar Association, Rawalpindi Bench, Ahsan-ud-Din Sheikh filed a petition praying the Supreme Court to direct the Federation to prosecute against Musharraf under Article 6 of the Constitution.Last week, President LHCBA, Rawalpindi Bench, Taufiq Asif had filed a plea under Article 184(3) of the Constitution.

Both the lawyers’ leaders have made the former president and Federation of Pakistan through Ministry of Law and Justice and Parliamentary Affairs as respondents.Ahsan-ud-Din prayed that the Federation be directed to notify a person under Section 3 of High Treason (Punishment) Act 1973 for lodging a complaint against Musharraf.While hearing a case two days ago, the chief justice remarked that Musharraf was in Pakistan but nobody had taken any action against him. Rather everybody was relying on courts, he added.
Last week, Sindh High Court while extending the protective bail to Musharraf directed him not to leave the country without the permission of the court. The SHC had granted protective bail to Musharraf on March 22 in three different cases.

The petitioners prayed to the apex court to direct the Federation to take Musharraf in custody immediately and start prosecution against him under the High Treason (Punishment) Act 1973.
They contended Musharraf by his acts and orders of November 3, 2007 and later, had assaulted the judiciary and tried to destroy this vital organ of the state. The former dictator undermined, curtailed and negated the independence of judiciary. They further submitted that Musharraf also blocked and obstructed access to justice by detaining the judges who were holding their offices constitutionally; and by substituting them with the adjudicators appointed unconstitutionally.
The petitioners recalled that it was so held by the apex court in the judgment in the Sindh High Court Bar Association case.On March 25, Tariq Asad advocate on behalf of former Lal Masjid chief cleric Maulana Abdul Aziz and Maulvi Iqbal Haider had filed a Civil Miscellaneous Applications (CMA), praying to place the name of Pervez Musharaf on the Exit Control List (ECL). They pleaded that Musharaf should not be allowed to leave the country till the final decision of this case.

Agencies add: General Musharraf's nomination papers were rejected on the basis of a complaint filed by invoking Articles 62 and 63 of the Constitution. According to the lawyer who filed the complaint, the former chief of army staff did not meet the criteria specified under this Zia-era provision which prescribes the qualifications for a member of parliament."Musharraf has been disqualified under Articles 62 and 63 of the constitution, among other reasons," an election commission official said.The officials, who declined to be identified, also said the decision was based on a clause in the constitution which requires candidates to be of good character and the fact that he had not declared all of his assets.

However, this does not necessarily mean an end to Musharraf's ambitions to enter parliament as he has also filed his nomination papers from three other constituencies: Islamabad, Karachi and Chitral. But, it remains to be seen whether the Kasur returning officer's decision will have an effect on his other applications.In a related development, a petition was filed before the Election Commission of Pakistan on behalf of Pakistan Muslim League (Nawaz) leader Ahsan Iqbal seeking Musharraf's disqualification because of his involvement in several cases including the assassination of former prime minister Benazir Bhutto.
