MUMBAI: In a new twist to the legal battle over the Jinnah House, the property of Pakistan's founder Mohammad Ali Jinnah here, a copy of his will bequeathing the property to his sister was found recently.

The will mentions that the leader bequeathed the property to his sister Fatima Jinnah, an official said.

Dina Wadia, Jinnah's daughter, has laid claim to the Jinnah House, a colonial bungalow on Mount Pleasant Road at upmarket Malabar Hill in south Mumbai.

"The will dated May 30, 1939 and a copy of legal certification from the Bombay high court was found in the records of the custodian of enemy property for India," Dinesh Singh, in-charge of the custodian office in Mumbai, said.

The high court in 1962 had legally certified the will as genuine and executed in Fatima's favour. "We have sent the copy to the ministry of external affairs for their perusal," Singh said.

Dina (90), a British national and mother of industrialist Nusli Wadia, approached the high court in August 2007 claiming rights to the bungalow on the ground that her father had not left any will.

According to Dina, her father was a Khoja Muslim and this sect followed the Hindu law and not the sharia. Hence, the Hindu Succession law that leaves the property to his daughter would be applicable and not the Islamic law where the deceased's siblings also have a right over the property.

According to the central government, after the enactment of the Bombay Evacuee Act in 1949, Jinnah House was declared as evacuee property and the government became its owner.

The central government, in its affidavit filed before the high court, had said it had decided to convert the house into a South Asia centre for arts and culture.
 
Well, there was logic in the decision taken.

Making it a center for art & culture is fair enough.

I wonder why Jinnah Didn't shoot her in the first Place , what a ****** who is defaming her own Father .

There is NO Khoja sect in Islam and neighter there is any other Inheriting law than sharia present among Muslims as far as i know & Baba did the right thing that he Kicked her out & she is banned from Entering Pakistan !

I dont care what you posted, but this image of Mr. Jinnah is very striking! The clarity and crispness of the image, for some reason, I find captivating. Though I am a big fan of black and white photography, maybe seeing a historical figure in such vivid colors is what I found captivating.

Edit: Oh now I can see it, its the eyes!!! You can see the eyes clearly. Eyes of famous personalities fascinate me!

The Khwajahs or officially Khojas (Urdu: خوجہ) are an ethno-religious community that are mainly concentrated in South Asia, but due to migrations over the centuries have spread to many parts of the globe. The word Khoja is a phonetic corruption of the word Khawaja, an Arabic/Persian title (Arabic: خواجه‎).
In Pakistan, Many Khojas migrated to and settled in the province of Sindh and especially in the city of Karachi. While in India, most Khojas live in the states of Gujarat, Maharashtra, Rajasthan and the city of Hyderabad. Many Khojas have also migrated and settled over the centuries in East Africa, Europe and North America. They are mainly adherents of Ismaili Shi'a Islam, but because of extensive periods of feigning their faith, minorities have adopted Hinduism, Sunni Islam, and Twelver Shi'a Islam.

is she really banned from entering pakistan, she came to pakistan a long time ago and she didnt want the media to capture her during her mazar e quaid visit
 
Could have been converted into a center for Pakistani art and culture with the Pakistani embassy as administrator.

Making the Pak embassy the administrator is not a good idea.

Pak could have a counter / place in the center like other nations or regions of the undivided sub continent.

That is correct that there is no 'Khoja' sect, but 'Khoja Shia brotherhood', which is primarily 'Ithnaasheri' (Twelver) Shia. Some Khoja also follow Aga Khani religion (in my opinion based on reading their origin, history and practices, Aga Khani is no Islamic sect but a separate religion). I happen to have few die-hard Khoja Shia friends and I can say with confidence that Deena's claim (that Khoja follow Hindu practices not Shariah) is totally wrong and based on utter ignorance which is no surprise as she herself is not a Muslims neither westernized Jinnah was a practicing Muslim (who would have introduced her to Shariah?).

In my opinion, the Malabar residence belongs to the Jinnah who was the citizen of the British India. After the partition, the properties (real estates) were abandoned on both the sides; sometimes claims were made, sometimes not. At any rate, those who migrated, lost legal claims on their properties left behind and were compensated (or not) by the respective government(s) of the country(s) (India or Pakistan) they immigrated to.

The issue of Malabar residence can only be resolved through goodwill, not through legal claims, at least that is how I see it.

The house belonged to the founder of Pakistan.

He left, willed it to his sister who too is no more. The GOI is within it rights to do as it seems fit. In any case relations between India & Pak are not good enough to hand over the property to Pak or its embassy.

Also, so doing will make the building the rallying point for orgnisations like Shiv Sena etc for anti Pak activities and is the surest way to ensure it get damaged. After Mumbai no one would even consider such a proposal.

Making it a center for art & culture is neutral enough. Undivided sub continent was not a mythical entity.

She married Neville against his will and this obviously led to a rift. Adding to the problems, was the existing and increasing distance between father and daughter owing to Jinnah's dedication to his mission. They came to terms with each other towards the later parts of his life. There are some letters validating this.
