Only in Pakistan, the lawyers, the politicians, the military, are all above the law. To make matters worse, the judges who are the keepers of the law are making a mockery of the system. It is safe to say that Judiciary activism has been prevalent in the last decade.

Let me give you some background of our Pakistani societies, family values, and culture, before I speak more about the state of the Judiciary. In Pakistani families, children are encouraged to become doctors and engineers, and those who fail to meet these standards are then encouraged to pursue Computer Sciences and Business Administration.

The next groups of kids usually turn to law practice by getting a degree in law. I will not say that this is the case for everyone, but it is definitely the norm. So now let us take a peek at the affairs of the judiciary in recent years in Pakistan.

It seems that most judges come from the same dynamics explained above. What would one expect from them? The same kind of judicial activism we see today in Pakistan! Let me give you a recent example: An independent TV Chanel, ARY News, did a show which showed an interview, where the guest accused a sitting provincial minister of taking bribes and also mentioned the name of a sitting high court judge of corruption.

Now the same judge takes suo moto notice and issues notice against the show and anchor of the show. The same judge sends a notice to NADRA (supposedly an independent regulatory authority) who issued a notice to suspend ARY News for 15 days while banning the show indefinitely.

Now let’s examine what is wrong with this whole issue! First and foremost, a judge cannot hear a case against himself - leave alone take suo moto. It is gross misconduct and conflict of interest. The judge is clearly violating his oath and code of conduct. All this stems from a corrupt government that is at the helm of affairs in Pakistan.

Judiciary has a much checkered history in Pakistan. We have complained of derailed democracy and military dictatorship, but we forget that each time it has happened, the judiciary has whole heartedly endorsed it - starting from the fist Marital Law imposed by Isqander Mirza, that was validated by Justice Munir, to the last Marital Law validated by Justice Iftikhar Chaudhry. The sad part was that Iftikhar Chaudhry became a champion of Judiciary, while there were references against him in the Supreme Judiciary Council that were never heard.

Pakistan needs a chance, but it can only come from an independent and honest judiciary. Pakistan’s founder was a man of law. He was an honest and dignified lawyer. Pakistan still has many lawyers and judges - who want to see dignity and honesty in the courts, and they are the ones who have to step forward and help create ‘the new Pakistan’.
