The sale of Reko Diq mining rights is currently being reviewed by Pakistan Supreme Court in response to allegations of lack of transprarency. The entire discussion in the courtroom is primarily centered on valuations and estimates of traditional metals like gold and copper. The second topic of discussion in the apex court is about the absence of any contract provisions for development of downstream job-creating industries to extract these metals.

What is conspicuously absent from the debate is the potential for extraction at Reqo Diq of rare earth elements that are even more precious and in much greater and growing demand for the latest high-tech equipment and batteries for all-electric autos, communications, and other applications than traditional precious metals like gold and silver. It is the estimates of these rare earths at Reqo Diq that could put the value of the contract at considerably more than the current best estimates of $500 billion for copper and gold.

Recent trade disputes between China and its major trading partners in the United States, Europe and Japan have been the result of China restricting rare earth exports.

A current production Toyota Prius nickel metal hydride battery pack uses 30 kilograms of nickel, 2 kilograms of cobalt and 12 kilograms of lanthanum because the active hydrogen storage alloy in the battery is either LaNi4.5Co0.5 or (Ce, La, Nd, Pr)Ni5. The Prius assembly plant in Japan has so far used one and 1.5 million rechargeable nickel metal hydride battery packs and achieved with them some of the lowest numbers of service issues ever seen in the OEM automotive industry. In fact most of the original Prius rechargeable nickel metal hydride battery packs have exceeded their 8-year 100,000 mile warranty and are still functioning, according to Resource Investor website.

China controls 95% of the world’s supply of rare earth elements, a class of ores used not just in Toyota Prius electric motors and batteries but in a wide range of high-technology applications, from sonar systems to wind turbines, mobile phones and fluorescent lights.

All this gives China an extraordinary - some might say unfair - advantage to lead the race to dominate the manufacture of cutting-edge technology, according to the Wall Street Journal. Even before any major technology partnership announcements, there are reports that the legendary US investor Warren Buffet is investing in BYD, an obscure Chinese battery, mobile phone, and electric car company.

Here is how an expert who asked not to be named explained the mining potential in Balochistan:

"The Pegmatite rock that covers much of Balochistan (and other parts of Pakistan as well) has several different gems, in it which have been mined for a long time. These are easy to visualize as they differ in color from the rest of the rock, and can be removed with a small geologist's hammer. Pegmatite, though, also contains uranium which can be separated using a Geiger Counter, and rare metals and rare earths. Some of these like Lithium can be separated relatively easily. Others like Samarium and Dysprosium are vastly more difficult to separate because you need X-Ray equipment to help identify them. Also, their presence is very small - that is why they are classed as "rare." The presence of many of these metals was not known to science until recently and until the Japanese began to use them in electronics, hardly any effort was made to mine them. Now, of course, they are all the rage because they have been found especially useful in the latest "green" generation equipment as well as in defense and other applications. Indeed, until China banned their sale to Japan, no one really even bothered about them - it suited the Japanese to remain quiet as they were getting very good prices for these resources from an unaware Chinese, and the same thing is now happening in other parts of the world, in Pakistan in this case.

Much of the testing that is involved here is difficult and requires very advanced technical equipment, and even methods like gas spectrometry etc may not help identify materials that exist in extremely small percentages in soil or rock. In India for example, some of these metal reserves were not known until the USGS first and then the Russians helped analyze soil and rocks across the country. If nothing else, the Indians formed a government owned company called Indian Rare earths Limited which comes under the Atomic Energy Commission and is directly under the Prime Minister of India. They do seem to have handled the conservation and exploitation of these reserves far better than is being done in Pakistan."


Given the potential for tremendous mineral wealth at Reqo Diq, Saindak and other similar sites in Balochistan and elsewhere in Pakistan, it is extremely important for the Supreme Court to insist on an independent panel of experts to evaluate it, and to base court orders on the findings of such panel. How the Supreme Court tackles these issues now will have a significant impact on the future well-being of Pakistan in terms of the availablity of public funds for spending on education, health care and other badly needed human development projects in Balochistan and elsewhere in the country.

The Reko Diq project sits in the restive province of Balochistan, which shares a border with Afghanistan and Iran, and was estimated to have cost more than $3 billion to develop.

Barrick Gold Corp. says an international trade tribunal has ruled in its favour on a dispute over a multibillion-dollar mining project in Pakistan.

The company, along with joint venture partner Antofagasta plc, took the Pakistani government to the World Bank’s International Center for Settlement of Investment Disputes after the country denied a mining lease for the Reko Diq copper-gold project in 2011.

Barrick says the tribunal rejected Pakistan’s final defence against liability on Monday and ruled the country violated terms of an investment treaty with Australia, where the Tethyan Copper Co. joint venture is based.

The tribunal will start proceedings to determine the size of the damages on March 22 with a ruling expected in 2018, Barrick said.

The Reko Diq project sits in the restive province of Balochistan, which shares a border with Afghanistan and Iran.

Barrick said the Reko Diq project was estimated to have cost more than $3 billion (U.S.) to develop and is one of the world’s largest undeveloped copper and gold deposits.

China will make a hefty profit from this if the news is true.

China are money driven and will drive a hard bargain as it has the expertise and know how of mining.

"CONDITIONAL Contract demanded the company develop fields in 5-8 years in 1999, Full fledge development, not just feasability studies or 5-7%: They failed miserably "

BHP sold their stake to TTC (When people demended answers to performance)
(Pakistan objected to this transfer and objected to one sided ammendments) - Contract nullified at this point , The state of Pakistan did not recognize TTC as partners in business )

  • Technically from Pakistan's side the ammendments done to origional contract were not acceptable, and this was reviewed by Supreme courts and they deemed the agreement Nullified

  • Supreme court has to check if changes made to contract are legal or not, that is why we have courts to look after such items

  • TTC sold their stake to Barrick Gold and Antofagasta. They technically sold them a paper or agreement which was already nullified by Pakistani Government

  • Nothing done on Site till 2008 , no impact by Gold / ntofagasta

So technically Pakistan does not owes anything because the deal was "Nullifed" due to objection by Provincial authorities to the deal , which is legal right of Pakistan. Also Supereme court stated Ammendments are not aggreable the contract is VOID

  • Can't Ammend a contract without Supreme courts agreement from Pakistan side

  • The deal is not recognized if it is nullified by Supreme Court of Pakistan

Court of Pakistan have SUPREME RIGHT over any business entity that operates on Pakistani Soil, and People of Pakistan have SUPREME right to demand revenue from BHP for the origional contract awarded.

Bro they already won the case, only thing left to decide is how much Pakistan most pay to TCC. Reko Diq now will be handed over to MCC which is some Chinese company already mining in Saindak Balochistan.

And what performance goals they achieved in first 9 years ? (BHP) that they decided to start selling their part of shares without Approval from Pakistan

Only such permission to mine was given to BHP (alone)

Any Exchange of Shares ownership has to be approved by Government of Pakistan/ Supreme courts of Pakistan

World bank can claim they think who is right but , I think Supreme corut (Pakistan) has decided our stance , we are not in business to Pay cash to unrecognized entities


If world bank can show people of Pakistan where are our Riko Diq mines projects 100% completed all fields as it was promised to us initially then sure consider things but there is no development on project



Example:

Lets say 1 person wants to build a car and they do a deal with BMW to make them a car in 6 months 100% completed car. I issue BMW workers VISA to come to my country so they can work on my car project (Authorization 100% done , all provincial approvals attained)

After 7 years have passed and then the BMW dealer has only completed a steering wheel saying progress is slow. When you as a customer demand answers to the slow nature. BMW sells the contract to build your car to Kia Motors.

So as a customer , why should I accept a Kia Motor to build my car?

So I will reject the offer 100% I do not recognize Kia Motors I want BMW to make me a Car only !!! Now Kia Motors sell the contract to another tiny car maker Yamaha (Motor cycle maker) (as example)

So as a customer do I recognize Yamaha or Kia Motors ? Or BMW, can a motor cycle maker make me a car like BMW ? NO!!! THE CONTRACT BECOMES VOID!!!!

Of course I will say I only recognize BMW as legitimate contractor who was suppose to make me 100% car


If lets say BMW has a grandmother in Europe and she decides ok BMW is right and owes me no car and I should get a sub standard car , developed by either Yamaha or Kia , then my answer this would be NO FAT CHANCE GRANDMA I INVESTED IN DEAL FOR BMW

No money due to BMW , becasue they never finished my car (They owe me car, failiure to deliver I suffered economical loss due to no car )
No money due to Kia motors as I don't know or recognize them
No money due to Yamaha motors as I don't know or recognize them

Federal/Balochistan government will hand over Reko Diq to Chinese company already working on Saindak mine. Deal will be worst then with TCC most likely.

If the case is that simple. They How the hell we Lost ? One may ask

Pakistan never had any chance. They didn't even agreed with 1 point of Pakistan case. TCC stuck gold without mining.

World Bank decisions are rejected all the time, we don't acknowledge any company other then BHP to whome we did not authorize to sell their part of deal (Unilateral action with out consent from Pakistan's Supreme court on ammendments)

Initial Deal : Pakistan + BHP (Valid and recognized deal choosen by Pakistan)
  • Poor Performance for 9 Years by BHP Between 1999-2008, could not get project fully running in 5-8 year period (Failiure to deliver)

  • Pakistan Seeks Damages from BHP for failiure to Deliver any meaningful return from Mining Project between (1999-2008), in almost 9 years they could not finish a simple mining project


Unrecognized actions:
(Every project allocated in Pakistan is carefully reviewed and approved before any entity is allowed to make changes in any deal / contract)
  • Sale #1 BHP to TTC (Not reconized by state of Pakistan/ Supreme court of Pakistan)
  • Sale #2 TTC to Barrick Gold and Antofagasta (Not reconized by state of Pakistan/ Supreme court of Pakistan)


  • REJECTED CLAIM DEAL WITH IT, BECASUE BHP NEVER FINISHED ANY MINNING PROJECT for 10 years

  • BHP produced $0 benfit to pakistan , so we will be $0 X 1 = $0 to any claim

Look at China in 2 years finished the Gawadar port and also the Coal mine project in Sindh almost completed. And that is not all they finished the power plants as well in 2-3 years

What is conspicuously absent from the debate is the potential for extraction at Reqo Diq of rare earth elements that are even more precious and in much greater and growing demand for the latest high-tech equipment and batteries for all-electric autos, communications, and other applications than traditional precious metals like gold and silver. It is the estimates of these rare earths at Reqo Diq that could put the value of the contract at considerably more than the current best estimates of $500 billion for copper and gold.

Recent trade disputes between China and its major trading partners in the United States, Europe and Japan have been the result of China restricting rare earth exports.

A current production Toyota Prius nickel metal hydride battery pack uses 30 kilograms of nickel, 2 kilograms of cobalt and 12 kilograms of lanthanum because the active hydrogen storage alloy in the battery is either LaNi4.5Co0.5 or (Ce, La, Nd, Pr)Ni5. The Prius assembly plant in Japan has so far used one and 1.5 million rechargeable nickel metal hydride battery packs and achieved with them some of the lowest numbers of service issues ever seen in the OEM automotive industry. In fact most of the original Prius rechargeable nickel metal hydride battery packs have exceeded their 8-year 100,000 mile warranty and are still functioning, according to Resource Investor website.

China controls 95% of the world’s supply of rare earth elements, a class of ores used not just in Toyota Prius electric motors and batteries but in a wide range of high-technology applications, from sonar systems to wind turbines, mobile phones and fluorescent lights.

All this gives China an extraordinary - some might say unfair - advantage to lead the race to dominate the manufacture of cutting-edge technology, according to the Wall Street Journal. Even before any major technology partnership announcements, there are reports that the legendary US investor Warren Buffet is investing in BYD, an obscure Chinese battery, mobile phone, and electric car company.

Here is how an expert who asked not to be named explained the mining potential in Balochistan:

"The Pegmatite rock that covers much of Balochistan (and other parts of Pakistan as well) has several different gems, in it which have been mined for a long time. These are easy to visualize as they differ in color from the rest of the rock, and can be removed with a small geologist's hammer. Pegmatite, though, also contains uranium which can be separated using a Geiger Counter, and rare metals and rare earths. Some of these like Lithium can be separated relatively easily. Others like Samarium and Dysprosium are vastly more difficult to separate because you need X-Ray equipment to help identify them. Also, their presence is very small - that is why they are classed as "rare." The presence of many of these metals was not known to science until recently and until the Japanese began to use them in electronics, hardly any effort was made to mine them. Now, of course, they are all the rage because they have been found especially useful in the latest "green" generation equipment as well as in defense and other applications. Indeed, until China banned their sale to Japan, no one really even bothered about them - it suited the Japanese to remain quiet as they were getting very good prices for these resources from an unaware Chinese, and the same thing is now happening in other parts of the world, in Pakistan in this case.

Much of the testing that is involved here is difficult and requires very advanced technical equipment, and even methods like gas spectrometry etc may not help identify materials that exist in extremely small percentages in soil or rock. In India for example, some of these metal reserves were not known until the USGS first and then the Russians helped analyze soil and rocks across the country. If nothing else, the Indians formed a government owned company called Indian Rare earths Limited which comes under the Atomic Energy Commission and is directly under the Prime Minister of India. They do seem to have handled the conservation and exploitation of these reserves far better than is being done in Pakistan."


Given the potential for tremendous mineral wealth at Reqo Diq, Saindak and other similar sites in Balochistan and elsewhere in Pakistan, it is extremely important for the Supreme Court to insist on an independent panel of experts to evaluate it, and to base court orders on the findings of such panel. How the Supreme Court tackles these issues now will have a significant impact on the future well-being of Pakistan in terms of the availablity of public funds for spending on education, health care and other badly needed human development projects in Balochistan and elsewhere in the country.

There is no win for any company(s)​

The company(s) in question has no legal status in Pakistan as any registered entity or right to do any minining

The summary of the issue is

Pakistan did a deal with BHP in 1999 (Origional Agreements ) BHP & Pakistan 2 partners

"CONDITIONAL Contract demanded the company develop fields in 5-8 years in 1999, Full fledge development, not just feasability studies or 5-7%: They failed miserably "

BHP sold their stake to TTC (When people demended answers to performance)
(Pakistan objected to this transfer and objected to one sided ammendments) - Contract nullified at this point , The state of Pakistan did not recognize TTC as partners in business )

  • Technically from Pakistan's side the ammendments done to origional contract were not acceptable, and this was reviewed by Supreme courts and they deemed the agreement Nullified

  • Supreme court has to check if changes made to contract are legal or not, that is why we have courts to look after such items

  • TTC sold their stake to Barrick Gold and Antofagasta. They technically sold them a paper or agreement which was already nullified by Pakistani Government

  • Nothing done on Site till 2008 , no impact by Gold / ntofagasta

"Ammendments were done to origional contract" discoverd by Supreme court of Pakistan after it was signed in 1999. This was deemed illegal by Supreme court of Pakistan" Important note Supreme court of Pakistan found "Ammendments to origional agreement was illegal"

Province was against TTC . So they logged a case in court Supreme court of Pakistan. The contract as a result was "Nullified". Due to "ammendments to origional contract which was illegal"

The new company TTC or Barrick Gold and Antofagasta were never granted a licence to excavate in Baluchistan


So technically Pakistan does not owes anything because the deal was "Nullifed" due to objection by Provincial authorities to the deal , which is legal right of Pakistan. Also Supereme court stated Ammendments are not aggreable the contract is VOID

  • Can't Ammend a contract without Supreme courts agreement from Pakistan side

  • The deal is not recognized if it is nullified by Supreme Court of Pakistan


Actual Parties (Pakistan / BHP)

  • Pakistan/ BHP deal in 1999 (Agreed between Pakistan / BHP) VALID, Pakistan has to validate any change in agreement (Parliment/Province/Courts). Review if it is constitutionally ok for national level contract

"Conditional Approval was given that BHP only would develop the field in 5-8 years to full 100% capacity not 1-5%. When performance goals were not met the Contract was approaching cancellation for failiure to bring project to 100% capacity !!!! "


The problem started when Ammendments were made and shares were sold with out Pakistan's approval

Un Recognized Transactions from Pakistan's Legal System:
  • BHP sold their stake to TTC (Ammendments not agreed by Pakistan: INVALID) Where is Supreme Court of Pakistan agreement on sale of shares? Did Pakistan issue no Objection letter?
  • TTC sold to Barrick Gold and Antofagasta (Ammendments not agreed by Pakistan: INVALID) Where is Supreme Court of Pakistan agreement on sale of shares? Did Pakistan issue no Objection letter?


Court of Pakistan have SUPREME RIGHT over any business entity that operates on Pakistani Soil, and People of Pakistan have SUPREME right to demand revenue from BHP for the origional contract awarded.

IMHO, the company was under pressure not to develop the mine since the minerals are strategic. My gut feelings is that it contained more than what's publicized. So, they took the delaying path. Great for Pak. Now, it needs to be developed under military supervision and with the Chinese expertise (where else can you go nowadays???). A great move from Pak. Tebrikler!!!

World Bank decisions are rejected all the time, we don't acknowledge any company other then BHP to whome we did not authorize to sell their part of deal (Unilateral action with out consent from Pakistan's Supreme court on ammendments)

Initial Deal : Pakistan + BHP (Valid and recognized deal choosen by Pakistan)
  • Poor Performance for 9 Years by BHP Between 1999-2008, could not get project fully running in 5-8 year period (Failiure to deliver)

  • Pakistan Seeks Damages from BHP for failiure to Deliver any meaningful return from Mining Project between (1999-2008), in almost 9 years they could not finish a simple mining project


Unrecognized actions:
(Every project allocated in Pakistan is carefully reviewed and approved before any entity is allowed to make changes in any deal / contract)
  • Sale #1 BHP to TTC (Not reconized by state of Pakistan/ Supreme court of Pakistan)
  • Sale #2 TTC to Barrick Gold and Antofagasta (Not reconized by state of Pakistan/ Supreme court of Pakistan)


  • REJECTED CLAIM DEAL WITH IT, BECASUE BHP NEVER FINISHED ANY MINNING PROJECT for 10 years

  • BHP produced $0 benfit to pakistan , so we will be $0 X 1 = $0 to any claim

Look at China in 2 years finished the Gawadar port and also the Coal mine project in Sindh almost completed. And that is not all they finished the power plants as well in 2-3 years

but atleast we lost the case and will be paying damages
the same way we lost the case in NJ project due to delay in completion of project
