CJ asks military to keep away from politics

ISLAMABAD: Chief Justice Iftikhar Mohammad Chaudhry said on Saturday the oath of the armed forces called for true allegiance to Pakistan by upholding the Constitution and by keeping away from political activities.

“I am persuaded to say this (because) during my talks with one or two very high-ranking officers, I discovered that they did not know the implications of the oath taken by the troops of Pakistan,” the chief justice observed in an address to a delegation of officers of the Command and Staff College, Quetta, at the Supreme Court building here.

Last week, the chief justice had suggested to bureaucrats not to follow illegal orders by their superiors and instead abide by their conscience and the law.

Noting at the outset of his speech the prime duty of the armed forces to defend the country against any external aggression or threat of war, the chief justice said that “the prime duty of defending the supremacy of the Constitution lies upon the Supreme Court”.

He pointed out that the 1973 Constitution, for the first time, introduced a new chapter for the armed forces containing provisions pertaining to their command and functions and an oath by every soldier to “bear true faith and allegiance to Pakistan and uphold the Constitution and that he should not engage himself in any political activities whatsoever”.

Recalling that before the promulgation of the 1973 Constitution, members of the armed forces used to take oath as prescribed in the Pakistan Army Act of 1952, Justice Chaudhry said the framers of the present statute made a conscious effort to delineate the armed forces’ role so as to make them responsible for the nation’s defence and security and also to safeguard the Constitution from any adventurism.

“Let me tell you that the role of armed forces has been clearly defined in Article 245 of the Constitution, which envisages that the armed forces shall, under the directions of the federal government, defend Pakistan against external aggression or threat of war, and, subject to law, act in aid of civil power when called upon to do so,” he said.

He told the officers that the Supreme Court, through different judgments, had also held that the solider and the citizen stand alike under the law and therefore both must obey the command of the Constitution and show obedience to its mandate.

However, he recalled, the “recurring conflict between the under-developed political system and well-organised army” in the country’s history when he said political crises were followed by military intervention and military rule.

“Thus, there emerged a vicious circle of brief political dispensation followed by prolonged military rule – a state of affairs that brought many setbacks and hampered the process of evolution of constitutionalism and democratic system of governance.”

Quoting Nobel laureate Amartya Sen’s saying that “a country does not have to be fit for democracy; rather it has to become fit through democracy,” he said military interventions in the political process always weakened democratic institutions and
adversely impacted on the constitutional and legal development in the country.

He regretted that democratic elected governments “never truly consolidated democratic institutions” and said: “Neither, they were able to enforce good governance, economic progress or the culture of rule of law in the country.”

The primacy of unelected institutions over representative organs left parliament weak and subservient to the executive, he said, noting that Pakistan did not have a popularly or directly elected legislature from 1947 to 1970 and that this situation also retarded the political development of the state.

He emphasised that since Pakistan was being governed by a written constitution, all powers and duties of armed forces must flow from the provisions of that charter that a heavy responsibility lay upon the shoulders of their officers to adopt patriotism and highest moral and professional standards. “Only then you will be able to defend your country from extraneous threats.”

Before concluding his speech, the chief justice quoted the remarks made by Quaid-i-Azam Mohammad Ali Jinnah in an interview to the Sindh Observer: “Now, if we want to make this great state of Pakistan happy and prosperous, we should wholly and solely concentrate on the well-being of the people, and especially of the masses and the poor. If you work in cooperation, forgetting past, burying the hatchet, you are bound to succeed.”

Welfare of the people must be the supreme consideration of all institutions and all functionaries of the state, Justice Chaudhry said, adding: “In adherence to constitutionalism and legal principles lies our salvation and future development as a civilised nation.”

I wonder who will remind the incumbent "CJ" and his kala coat dudes (who BTW are responsible for all the economic mess and corruption) to stay out of politics as well.

Its their job to catch Politicians !! and Catch ppl selling assets cheaply of gifting them for 1% of price thats called protecting law and order civil order

Army's job is to go fight and bring down drones , not go have tea with enemies generals and ask to please stop dropping bombs on civilians

CJ has been out of politics or you know what fate awaits Musharaf. Not to forget Musharaf is still unprotected for the second Martial Law he imposed. Also this PPP has violated 10s of the orders which Supreme Court issued and they are still not pulled to the level they deserve. You may have your political bias against CJ OR Judiciary but not to forget there are only few who believe that.

The question you and entire Pakistan should be asking is why Chief Justice of Pakistan felt the need or was willing to or if he has the constitutional right to address the Army's Command and Staff college Quetta. If I'm not mistaken one of the points of the reference sent to SJC by Gen. Musharraf was this.

Apart from saving his kursee (chair) what good has CJP or kala coats brought to this country? only judicial activism. Yes, PPP's incompetence and corruption is beyond grief but isn't his responsibility to address the issue? oh well, people in Pakistan deserve it.

As for judiciary, read TI 2010 report it clearly states judiciary holds no. 2 position in terms of bribes paid by people and nothing has been done to address the issue for the past 3+ years. I was pretty much right from day one, the people who supported the movement to destablise rising Pakistan were fooled.

If you accept the first part that Chief of Army Staff is bound to serve under constitution and what CJ said was enforcement of that then there is no point to discuss this any further. I wonder if in your opinion ego of military chief is that fragile that assertion to his constitutionally defined role would hurt him then there is a problem somewhere.

Kala Coat issue is separate.. don't forget Asman Jahgir (a ppp jiala), Latif Khosa (twice alleged and removed from his post), the Lawyers who are serving for ISI, the lawyers of PMLN are all flavors of the same lawyer clan which have many problems in itself. But you cannot connect kala-coat with Judiciary as not all the kala coat were with CJ neither all kala-coat say what CJ say. Also the judiciary is not an ideal judiciary and there are 100s of areas where it has to improve. However by showing the bad side, you cannot tarnish the good side of Supreme Court or CJ himself.

I'm sure if an audit of military dept. is allowed and made public then you may not find judiciary at no. 2 anymore. But its not debate of who is corrupt and who is more corrupt.. its a matter of staying within limits and working under accepted framework. CJ has only asserted what the boundaries are and this shouldn't be a matter of pain to some of us. If this aspect is pinching, then the problem areas are being exposed.

Its the military plus politicians that are protecting what you called as "thugs". Who signed NRO and allowed BB and Zardari to come back???
And then who gave Musharaf Guard of Honors on exit and is still protecting him abroad as well.???

If politician are not implementing the NRO verdict of the SC, the military is doing the same is missing persons case.

Judiciary has to improve its performance specially the lower courts.

And One member said judiciary is no2 in corruption, then you should also see and read those reports which say that judiciary is the most respected institution now in pakistan and people have started to have firm beleive on this judiciary.

yea I guess military to stay away from Politics but instead shold focus on how to protect the pplz of Pakistan from the attacks/drones of US/NATO...
thats their actual job...not just to sit on seats and go office , collect paychecks etc etc...:azn:

Military is doing its job of following governments orders while the senseless awam keeps selecting thugs to run their country. Dont make a habit of finding escape goats to blame all the problem of the country on few individuals.

No matter how much load of nonsense you post try to prove that CJ is honest and blah blah blah the fact still remains that CJ is a poodle of the government, and PMLN PTI etc parties. CJ restoration rallies were the biggest in the nation's history but today 3 years have past and all the coward so called opposition leaders are just making a fool out of awam while thugs are ruling the nation. Where is that coward Imran joker Khan these days? I thought he was demanding the entire nation to come out in street to remove Zardari? BS.
If Pakistan is indeed "Islamic" republic of Pakistan then its judiciary should be following what Allah SWT and Prophet Mohammed PBUH says "judge matter according to Quran, Hadis, Sunnah" but today Pakistan is only following corrupt man made system and and Islam has been thrown out of such affairs.
So the point is, Pakistan's Judiciary is corrupt of HIGHEST ORDER! And corruption and hypocrisy is in Pakistan's destiny so get use to it. and CJ is a coward of highest order.
