Chinese Americans continue to be victimized by racial profiling: Opinion | Asia Times

America welcomes immigrants and they come from all over the world. For Chinese-Americans, the dark side of this land of opportunity is that they continue to be victimized by the law enforcement’s hair trigger inclination to prosecute according to a racial profile.

Rather than compiling evidence beyond a reasonable doubt, the FBI and fellow practitioners will jump at any flimsy thread of possible wrong doing, make a public arrest, sent out a press release on their accusation and put the hapless Chinese American in detention.

When their findings are then subject to scrutiny and fail to pass muster, the charges are quietly dropped. By then, of course, the reputation of the person is in tatters and the victim’s life and finances are in ruin.

The latest such victim was Sherry Chen, a hydrologist working for National Oceanic & Atmospheric Administration (NOAA). The headline of the New York Times article said it all: “Accused of spying for China until she wasn’t.”

According to published sources, Ms. Chen is from Beijing who immigrated to the U.S. and became a naturalized American citizen in 1997. The second piece of damming evidence against her is that she goes back to China every year, allegedly to see her aging parents. The third piece of evidence is that she has a classmate who is now a vice minister at the Ministry of Water Resources. He apparently told her that he would like to know how the repair of old dams is financed in the U.S. — a threat to homeland security if ever was one.

She was caught red handed when she promised in her email to see what public information is available on the subject. By any generally accepted definition, public information is non-confidential and non-proprietary and cannot be intelligence-related to national security. Unfortunately for Ms. Chen, she asked to borrow a password from an acquaintance to access the database on dams in America.

Worst of all, when she was asked the year she met the official at the ministry, the answer she gave was off by one year. She claimed she was confused. Since she goes back to Beijing every year, the prosecution could have allowed for her confusion but instead they accused her of lying.

As of the date of this report, all the charges against Ms. Chen have been dropped and she is apparently seeking to return to her job at NOAA, a job for which she has received awards and commendations. There was no public information on whether she will seek redress to the injustice done to her.

Anyone thinking that Ms. Chen is entitled to compensation for such shameful government conduct do not know that the scale of American justice is overwhelmingly tilted in favor of the government, misconduct or not, and the wheels of justice grinds at a snail pace.

Take the case against Dr. Bo Jiang. After his Ph.D. degree, he found work as a NASA subcontractor. When his contract expired and he did not get permanent residence to remain in the U.S., he bought a one-way ticket to go home to China — the feds tend to regard a one-way ticket as a tell-tale sign of sinister intentions.

The then Congressman Wolf’s gut was convinced that Jiang must be a spy and had him yanked off the plane and incarcerated. Despite violating his civil rights and finding not a shred of evidence to justify putting Jiang in jail, he was released only after agreeing to plead guilty to one misdemeanor count in exchange for the seven weeks of jail time he already served.

He saved the U.S. government’s face but it was doubtful that he got any thanks for his generosity. He won’t be allowed to come back to the U.S. though it would be doubtful that he would want to.

In a June 2013 press release, FBI Executive Assistant Director Richard McFeely expressed satisfaction at their effort to catch spies. He said, “Since 2008, our espionage arrests have doubled, indictments have increased five fold, and convictions have risen eight fold.”

McFeely did not explicitly tie his remarks to Chinese-American spies but the release was in the context of trade secret dispute between an American company and one in China. By his way of accounting, Bo Jiang’s conviction would have counted as a win for the FBI. Missing in his remarks was any indication of their record of wrongful arrests.

Dr. Haiping Su came to the U.S. for graduate studies and became a naturalized citizen in 1991. After various job changes, he came to Silicon Valley to work as a NASA subcontractor. The security chief for NASA in Mountain View decided that Su looked suspicious and had him abruptly removed from the Moffat Field premises.

In Su’s case, he sued NASA and the federal government for violating his privacy and civil rights. Amazingly enough, after 6 years of legal wrangling, he actually won his suit and a pittance of a compensation that could hardly compensate him for the mental anguish he endured.

The irony is that Chinese-Americans have been punching far above their weight. According to the Migration Policy Institute, “Compared to the overall foreign- and native-born populations, Chinese immigrants are more highly educated, more likely to be employed, and have a higher household income.” Among the approximately 2 million Chinese Americans in the U.S., 47% have bachelors or higher college degrees as compared to 30% for native-born Americans.

According to the Department of Homeland Security Yearbook for 2013, the latest available year, the number of Chinese given lawful permanent residency in the U.S. for the decade from 2004 to 2013 was just over 745,000, second in number to those from Mexico and make up close to 7% of the total granted a green card for the decade.

Yet for the same period, slightly less than 340,000 from China went on to become naturalized citizens, representing only 4.7% of the 7 million plus that became citizens. Between Mexico and the five major Asian countries of origin (India, Philippines, S. Korea and Vietnam), China was the only country with a significant drop in relative percent and failed to maintain their pro rata share of newly naturalized citizens.

It’s not possible to draw too many conclusions without further study. We can speculate, however, that even though Chinese-Americans enjoyed on the average a household income 30% higher than national average, many felt the sting of being regarded as perpetual foreigner and potential spy and eventually chose to go back to China.

It may not be as brutal as being shot in the back but those that have been victimized by wrongful arrest and put through the psychological wringer for months can tell you, it’s no fun to see one’s professional career destroyed in one sudden capricious moment.

Interesting development. I certainly take no joy in seeing our diaspora brothers victimized abroad, especially considering they are usually among the most productive newcomers in their adopted homelands. But from a coldly realist and nationalist point of view, China may have much to gain from the human capital inflows it will get as a consequence of overseas persecution. After all, the father of Chinese rocketry, Qian Xuesan, was an American who, prior to getting ensnared in the McCarthyist campaigns, very much loved the US. Subsequently, after fleeing to China, he made invaluable contributions to China's missile and space programs.

At the very least, I would say that the Chinese government should expend absolutely no diplomatic capital on this issue, no matter how dire the persecution. Keep it hush hush, but give a warm welcome to the (former) Chinese Americans when they return home.

Any Chinese stupid enough to live in enemy America deserves all the racism they get. If you were Jew would you choose to live in Nazi Germany or flee for your life? The fact these Chinese have not yet fled for their lives means they do not know about America's concentration camp back-up plans for Chinese Americans.

What these Chinese Americans did not understand when being questioned is that they should have a lawyer beside them. the article did not state whether or not they did or did not.
At the very least they should learn this phrase. "I plead the fifth..."

If you don't want ethnic Chinese to come under suspicion then stop using them as spies.
China does have a long history of using racial/ethnic ties as component of her foreign affairs.

The Malaysians must be suspicious of Deng. There were underlying suspicions and animosity between Malay Muslims and Chinese in Malaysia, and between Indonesians and their ethnic Chinese. Because China was exporting revolution to Southeast Asia, my Asean neighbors wanted Singapore to rally with them, not against the Soviet Union, but against China.

Asean governments regarded radio broadcasts from China appealing directly to their ethnic Chinese as dangerous subversion. Deng listented silently. He had never seen it this light: China, a big foreign power, going over the governments of the region to subvert their citizens. I said it was most unlikely that Asean countries would respond positively to his proposal for a united front against the Soviet Union and Vietnam and suggested that we discuss on how to resolve this problem. Then I paused.

Deng's expression and body language registered consternation. He knew that I had spoken the truth. Abruptly, he asked, "What do you want me to do?" I was astonished. I had never met a communist leader who was prepared to depart from his brief when confronted with reality, much less ask what I wanted him to do. I had expected him to brush my points aside as Premier Hua Guofeng had done in Beijing in 1976 when I pressed him over the inconsistency of China's supporting the Malayan Communist Party to foment revolution in Singapore, not Malaya. Hua had answered with bluster, "I do not know the details, but whenever communists fight, they will win." Not Deng. He realized that he had to face up to this problem if Vietnam was to be isolated. I hesitated to tell this seasoned, weather-beaten revolutionary what he should do, but since he had asked me, I said, "Stop such radio broadcasts; stop such appeals. It will be better for the ethnic Chinese in Asean if China does not underline their kinship and call upon their ethnic sympathy. The suspicion of the indigenous peoples will always be there, whether or not China emphasizes these blood ties. But if China appeals to these blood ties so blatantly, it must increase their suspicions, China must stop radio broadcasts from south China by the Malayan and Indonesian Communist Parties.
That is not saying all Chinese-Americans are agents for China, but it is acknowledging an uncomfortable fact on the table, a fact that was created by China decades ago and a tactic that intelligence agencies worldwide exploited. The Chinese members here cannot claim innocence when they believe Israel uses the same tactic for Israeli Jews and American Jews.

Both Godfrey and Hensley stressed that the overwhelming majority of Chinese-Americans in California are viewed as loyal to the United States. In fact, said Godfrey, most U.S. successes against Chinese spying have come because of help from the Chinese-American community.

"When we talk about China, we're not talking about a threat by any ethnic group," said Godfrey. "It's just that certain people in that group are targeted for recruitment."

I would think the Asian race is highly touted and respected here more so than even in China where they would be payed slave wages. maybe they fled the mainland for a reason, or am I just being a dramatic nilly :rofl:

According to a classified UK travel briefing released today in full by WikiLeaks, Chinese intelligence activity has become "widespread" with a "voracious appetite for all kinds of information; political, military, commercial, scientific and technical" being fed by bugged hotel rooms and a "mass of ordinary students, businessmen and locally employed staff who are working (at least part-time) on the orders of various parts of the State intelligence gathering apparatus."

Chinese espionage efforts, designed to clone Western technology have become more sophisticated: "The Chinese have realised that it is not productive to simply steal technology and then try to `reverse engineer it'. Through intelligence activity they now attempt to acquire an in-depth understanding of production techniques and methodologies. There is an obvious economic risk to the UK".

Chinese agents are "expert flatterers and are well aware of the `softening' effect of food and alcohol.". Under the cover of consultation or lecturing, a visitor may be "given favours, advantageous economic conditions or commercial opportunities." In return they will be expected to "give information or access to material. Or, at the very least, to speak out on China's behalf (becoming an `agent of influence')."

Racial profiling in the interests of national security issues is contingent upon whether the adversary government uses race/ethnic as a tactic in espionage. The Soviets did it. So did the East Germans. And just about every governments, including allied governments, that have interests in America. YOU may not like what/how we do, but what do you care ? You are not in America to 'suffer' American injustices, right ? Are you going to deny that China uses race/ethnic ties in espionage when your own Deng Xiaoping admitted such tactic have been used ?

The US may not be perfect, but I laugh every time I see someone from a country with worse human rights violations criticizing US.

There aren't a lot of Chinese here. About 0.5 percent of the population and not likely to grow as they don't have marry children and intermarry frequently.

Well, the Chinese Americans should stay away from the high security clearance jobs, consider your ethnic background, it is impossible for not getting racially profiled.

If your motherland China is as weak and insignificant as some African countries, then you don't have to worry about this issue at all.
