Chairman NADRA removed as per contract: Ministry
ISLAMABAD: Additional Secretary Interior Ministry Athar Sial informed the Senate Standing Committee on Interior and Narcotics yesterday that Tariq Malik was removed from the post of Chairman NADRA according to his contract.
He stated this during a hearing on the affairs of National Database and Registration Authority (NADRA) by the Senate Committee in Parliament.
The committee discussed matters related to the removal of Tariq Malik from the post of Chairman NADRA.
Chairman Senate Committee Senator Muhammad Talha Mehmood, Senator Shahi Syed, Senator Col. (R) Syed Tahir Hussain Mashhadi and Senator Begum Najma Hameed attended the proceedings of the committee.
The committee recommended to the federal government to provide security to Tariq Malik as he had been receiving threats from some persons. –APP

The government put cold waters on opposition’s seemingly charged plan of slamming the government over dismissal of NADRA chairman through a few disclosures.
Pakistan Tehreek-e-Insaf and Pakistan Peoples Party had teamed up against the government over sacking of NADRA Chairman Tariq Malik — who was immediately reinstated by Islamabad High Court — as they built up their case that the move was aimed at concealing rigging in general elections through verification of voters’ thumb impression.
The opposition, perhaps, had not done its homework to make its case stronger but Interior Minister Chaudhry Nisar Ali Khan was waiting for the opportunity to hit hard at both the opposition groups separately. Though Nisar responded to the questions raised by the opposition, he did not answer one question: Why the government sacked NADRA Chairman in the middle of night?
Responding to opposition’s allegations, he said that the matter was sub judice as the government has challenged IHC decision in the Supreme Court and he was sharing details of the case out of compulsion to put the record straight.
He assured the house that the government will implement court’s decision on the case, whatever it is, contrary to the practice of past regime. Nisar started with appointment procedure of Malik and said he was taken as General Manager of NADRA, without following the due process. Later on he was taken as Deputy Chairman, a post which does not exist as per rules and then was promoted to the office of Chairman.
“The previous government appointed Malik as chairman through relaxation of rules,” Nisar said and added “I can produce documentary evidence before this house.” The minister revealed that the incumbent Chairman had been denying, despite two letters, to present the accounts of NADRA for audit.
In addition, he said, the chairman had been ‘leaking’ news to the media without prior approval of his ministry. “I had told the Chairman in the middle of a meeting, and in front of everyone present, that I will sack you if NADRA accounts are not audited,” he added.
In response to PTI’s questions, Nisar said that “the government was ready to go for thumb impression verification of all 272 seats (directly elected) of the National Assembly under the supervision of PTI’s member Justice (retd) Wajihuddin Ahmed.”
“I can tell you the results right now that thousands of votes would not be verified as magnetic ink was not used.” It is either the Election Commission of Pakistan or the caretaker government responsible for not using the specific ink, he added.
He said that NADRA chairman had nothing to do with the verification of the votes as election tribunals or courts would order that.
Earlier, PTI chairman Imran Khan said the government removed the NADRA chairman to disrupt the process of thumb impression verification. The chairman was under pressure for quite some time and was removed at the end, he added.
Leader of the Opposition Syed Khursheed Shah said he was concerned because there were allegations of rigging in general elections and NADRA chairman’s removal at this juncture gave credence to that.
Shah Mehmood Qureshi of the PTI questioned the government as to why it had removed the chairman in the middle of the night and as to why due process had not been followed in the action.
After Nisar’s reply, both the PTI and the PPP were taken aback as they said they have nothing to do with the administrative issues related to the case. But both were sticking to their views regarding allegation of rigging in elections.
Govt moves SC
The federal government challenged the reinstatement of NADRA Chairman Tariq Malik in the Supreme Court. In its petition, the federal government through its counsel Akram Sheikh stated that NADRA Chairman holds dual nationality of Pakistan as well as Canada.
“It is humbly submitted that NADRA database contains, critical, confidential and highly sensitive information pertaining to the citizens of Pakistan which information if placed in the hands of a person whose allegiance is not solely to Pakistan is potentially in the possession of a foreign national and hence may be available to any foreign entity,” the government pleaded in its petition also made available with The Express Tribune.

Official faces tough time in Senate committee over Malik’s sacking
ISLAMABAD, Dec 5: The government conceded on Thursday that Nadra chairman Tariq Malik had been sacked without a show-cause notice having been giving to him, but insisted that the decision was in line with terms and conditions of his contract.
Interior Ministry’s Additional Secretary Athar Sial told the Senate’s Standing Committee on Interior that the contract could be ended by either side after giving a one-month notice or paying one month’s salary.
“Since the government was ready to pay one month’s salary, there was no need to serve any notice.”
Mr Sial claimed that Mr Malik had been appointed as chairman of the National Database and Registration Authority without a fair competition and the then prime minister had approved special terms for him.
The response, which came after a bit of hesitation on the pretext that the matter was sub judice, failed to satisfy the committee and some of its members asserted that no executive order could override constitutional and legal provisions.
Retired Colonel Tahir Hussain Mashhadi of the MQM pointed out that under Section 3(12) of the Nadra Ordinance, the chairman could only be removed on grounds of mental illness.
The committee was of the view that the apparent mala fide decision of the government was linked to verification of thumb impressions of voters of a constituency in Lahore.
At least two members of the committee said that Mr Malik was sacked for refusing to obey illegal orders.
Interior Minister Chaudhry Nisar Ali Khan did not attend the meeting.
Nadra chairman Tariq Malik, who had been invited to the meeting, told the committee that the termination letter had been delivered at his residence at 1.30am on Wednesday.
Describing the government move as operation ‘Midnight Jackal’, he said it came the day he was to brief Punjab Chief Minister Shahbaz Sharif on pro-poor management and subsidy system. Provincial Law Minister Rana Sanaullah took the briefing on behalf of the chief minister.
He said his subordinate Brig Zahid Hussain had informed him about the termination of his contract and instructions of the interior secretary to hand over the charge to him.
Mr Malik said no senior official, including the interior secretary, was available on phone to confirm the sacking, and left him with no option but to approach the court.
The chairman of the committee, Senator Talha Mehmood, said Brig Hussain had faced two inquiries and he was found guilty in one. “How can such a controversial person replace the head of an authority with unblemished credentials?”
He sought reports of the two inquiries at the next meeting of the committee on Dec 11.
Mr Malik confirmed that he had received threatening phone calls and also a letter which warned him against verifying thumb impressions of voters in some Punjab constituencies and he reported the matter to the interior ministry.
The Additional Secretary of the Ministry of Interior informed the committee that the Inter-Services Intelligence and Intelligence Bureau had been asked on Nov 23 to carry out a thorough investigation, but their reply was awaited.
The committee decided to summon officials of the two agencies at the next meeting for information about the status of investigation and directed the interior ministry to provide appropriate security to Mr Tariq Malik.

While expressing concern over the unceremonious removal of NADRA chairman, who was immediately reinstated by the Islamabad High Court, the Senate Standing Committee on Interior directed the interior ministry to provide him foolproof security.
The committee took it seriously that the government had resorted to “an unlawful step” removing an officer only because he was verifying the fingerprints in the election results, particularly in Lahore, and in a constituency where some key politicians had not only managed to reach the assemblies but also hold top positions in the corridors of power.
The committee, with Senator Talha Mehmood in the chair, also criticised the government for appointing Brig (retd) Zahid Hussain as acting chairman NADRA, a very junior official against whom two serious cases had been pending, and he was even ‘found guilty’ in one.
The committee noted that in the light of Anita Turab’s judgment of the Supreme Court, no civil servant should obey wrongful orders of the authorities.
NADRA Chairman Tariq Malik told the committee that he was continuously receiving threatening calls from certain quarters, asking him to shun the verification process of votes in Lahore and he informed the government through letters and provided details of the phone numbers too.
Commenting on his removal, he said, I did not receive any notice before termination which is mandatory as per the NADRA Ordinance. A letter was dropped with a cheque at midnight at my home in my absence, and even my wife never received it.
“I cannot be removed unless there is a physical complication or any allegation of financial irregularities,” he maintained. “I would have resigned had the prime minster, interior minister or interior secretary asked me to do so with a valid reason but the unceremonious removal forced me to seek justice for the sake of my credibility,” said Malik.
He specifically mentioned that when he joined NADRA, there was only two months’ salary with the organisation. But now NADRA is a self-sufficient organisation, the 50th among the world’s top ranking organisations, he added.
Talha Mehmood said that NADRA chairman could be appointed and removed as per NADRA ordinance and it is the act of Parliament and no notification could nullify it.
