Bundeswehr dismisses Muslim soldier because he did not want to shake hands with female

a Higher Administrative Court has confirms judgment of an administrative court that the dismissal is correct.

A soldier of the Bundeswehr has failed with a lawsuit against his dismissal. He had refused to shake hands with women. According to the Bundeswehr, this would have damaged the reputation of the troops.

The refusal to shake hands with women on religious grounds justifies the dismissal of a time soldier. The Higher Administrative Court of Rhineland-Palatinate in Koblenz rejected the complaint of a former soldier in a decision published on Thursday. The dismissal was based on a violation of military duties and not on a prejudice of Muslims, decided the judges.
Continuing employment would have damaged the reputation of the Bundeswehr

The plaintiff was since 2015 a time soldier. In 2017, the military screening service provided insights into a man's allegedly extremist attitude. He converted to Islam and changed his appearance and behavior. There is a suspicion that the soldier is in a process of radicalization. In a survey, the plaintiff testified that it was up to him if he did not shake hands with women. In May 2018, the soldier was released. The appeal of the plaintiff, the Higher Administrative Court now rejected.

The administrative court had rightly dismissed the claim, judges ruled. Through his religiously justified refusal to shake hands with women, he violates the duty to stand up for the free democratic basic order. In addition, he violated the duty of respectful and trustworthy behavior. A continued employment of the soldier would have seriously endangered the military order and the reputation of the Bundeswehr.
Operational capability of the army endangered

The former soldier claimed to have worked well with women and to respect them. According to his own statements, the plaintiff also gives other people his hand for hygienic reasons only in exceptional cases. The reasons given by him for his behavior towards women in view of his consistent turn to Islam only protection claims, judges ruled. The attitude of the plaintiff contradicts the equality of man and woman in the Basic Law.

Irrespective of the fact that there is no provision for a welcome by handshake, the behavior of the plaintiff justifies the assumption that he does not sufficiently respect female comrades and jeopardizes the operational capability of the Bundeswehr. There is considerable doubt that a soldier who shuts hands with women is ready to stand up for female soldiers.

A German Muslim in the Army? Isn't that rare. But not surprising, Bundeswehr is like an Army city, they're very strict - so expected.

there are no exact numbers about how many muslims are in the Bundeswehr, the Bundeswehr is neutral and dont ask what their soldiers belive, information about religion is voluntary. About 3000 soldiers claimed to be muslim that are only 2% ... but 25% of all soldiers have migration background, 14% of the NCO´s, 10% of the officers up to the rank captain, 7%of officers ranking major or higher

handshake is a universal sign of mutual respect between 2 people in virtually every society/culture in the world.

I just cannot imagine how uncivilized rude and disrespectful someones has to be to refuse a handshake... you don't belong in modern society in my opinion.. go live out in a cave somewhere

I shake hands with females, but I find it ludicrous how the West feels so insecure when someone doesn't. Keep your insecurity to yourself and don't impose your shit onto others.

It is sunnah not to shake hand with opposing sex. It should be like this for any one finding that the other person dont want to touch your hand.

They talk about 234 reported cases of SUSPECTED crime... that does not mean that there happend realy something...

The article clearly claim part of the increase was reopening and reinvestigation of older cases.

Only 14 cases were atemp to rape or real rape

The report does not claim how many of the cases are fail claims by female soldiers as a revenge, studys in Germany have shown that 45% of all civil cases of claimed sexual offences never get to court because the police investigation has found no proofe of the claim, or realized the female lied.

BTW the quote in the Bundeswehr is realy low.... in the US Army they have over 6100 claims of sexual abuse each year.

How about Turkey...dont tell me there is no sexual abuse ;)
