It was the BJP that created this liability law and headache when they were in opposition I'm told. Else this would have been place years ago.

Well better late than never. This is going great for both countries.

Well..it's not official yet. Then again the buzz is..this deal is likely to be announced today... a huge shot in the arm for Mr Modi. Would be interesting see liability clauses in the final agreement!

Because it was not finalised ... now it is . So work will start very soon

Misleading title - Its all about amending/diluting the Nuclear Liability Act passed by the Indian Parliament which was one of the last steps needed to activate the 2008 Indo-U.S. civilian nuclear agreement.

Kya naya hai?? whats new? there was a nuclear deal signed in 2006. But there was not single reactor or tech from US.

The Indo-US nuclear deal has led to generation of 1840 MW nuclear power from imported fuel for the country's reactors till July 2014.

1840 MW nuke power generated after Indo-US nuclear deal - Economic Times

The Civil Liability for Nuclear Damage Act, 2010 or Nuclear Liability Act was one of the last steps needed to activate the 2008 Indo-U.S. civilian nuclear agreement and the act came into force from 11 November 2011. These negotiations were to dilute/amend the same law which is already enacted after being finalized.

While India is putting up indigenous nuclear plants, their capacity is less than what Russia, France and the US are offering. But all the suppliers have objected to Sections 17(b) and 46 of the Act which they say run counter to the International Convention on Supplementary Compensation for Nuclear Damage (CSC).

The CSC requires domestic liability laws to conform to a model text but the Indian law is tougher as it allows legal action against suppliers if an accident is caused by faulty or defective equipment. The U.S. has been candid in stating that the Indian law violates the CSC. Russia, Canada and France have similar reservations but are not public about them.

Next target...membership of Nuclear Suppliers Group. That will really make a huge difference to India's standing in the nuclear world.

well...this newly introduced track back clause by US is nothing but bargaining chip. Looks like they succeeded in getting some concession on liability law by giving up fuel tracking!

Even then India is not going to import any reactors from America unless we get ENR tech. To read more about what it is and why we really signed the nuclear agreement with the US, please see the responses from Olivers in this forum
