Forged documents? No NOC issued for Imran’s Bani Gala mansion, SC told

ISLAMABAD:

Permission documents pertaining to the construction of PTI chief’s palatial house in Bani Gala have been termed as fake by former officials of the Bhara Kahu union council.
This was disclosed in a report of the Islamabad Capital Territory (ICT) Chief Commissioner Office which was submitted to the Supreme Court by Additional Attorney General Syed Nayyar Abbas Rizvi on Wednesday.

A three-judge bench of the top court, headed by Chief Justice Mian Saqib Nisar, is expected to take up the case on Thursday (today).

Former Bhara Kahu Union Council (UC) chairman and secretary, in their separate statements, said that neither had they issued the no-objection certificate (NOC) nor had they approved the site plan for construction of Pakistan Tehreek-e-Insaf (PTI) Chief Imran Khan’s 300 kanal mansion.

Yaqoob Malik, the former Bhara Kahu UC chairman, stated in his written statement that during his tenure as UC chairman from 1987 to 1991, he did not issue the NOC for building the house in Bani Gala.

He, however, admitted that someone had managed to obtain a letter from his office with his signatures on it, but termed the document as ‘falsely prepared’.

“My name on the NOC letter is incorrect,” Malik pointed out, adding that according to his information Imran had purchased the property sometime after 2002.

Muhammad Umar, the former Bhara Kahu UC secretary, confirmed that he had held the post is 2003. He testified that the writing on the document, which had been furnished to the SC, was not issued by them.

Umar, however, recalled that at the time, they did not have computers in the UC office. Hence, all official correspondences were carried out using handwritten letters.

Moreover, he recalled that the applicant had been asked to submit the site plan so that it could be forwarded to the relevant authorities for further process, but the plan was never submitted. Curiously, Umar added that no further action was taken on it.

The SC had on February 22 directed Imran’s counsel Babar Awan to have the NOC and site plan of Imran’s mansion verified by the UC.

The bench had taken up a suo motu notice on a letter written by Imran inviting the court’s attention towards unchecked and unplanned construction in the Bani Gala area along with large-scale tree felling and pollution of the Rawal Lake.

At the last hearing of the case, Awan had furnished the site plan, an NOC dated July 2, 1990, and a proper notification certificate in favour of Imran dating to 2003. The documents had been provided in compliance with past orders of the three-judge bench.

The court, however, had asked whether the site plan had been formally been approved, and directed the Islamabad Administration to confirm it.

Islamabad additional commissioner in his report stated that Imran’s former wife Jemima Khan had purchased land measuring 300 kanals and five marlas for Rs43.536 million.

The report further reveals that when the land was purchased, neither was an NOC from the Ministry of Interior nor a Pakistani identification document of Jemima was produced before the revenue officer.

Moreover, it says that when land was purchased, Jemima did not appear before the revenue officer. Curiously, no one appeared on her behalf in the four subsequent property mutations. Only Major (retired) Pervaiz Malik appeared for one of the mutations.

What after so many years, properties are still being built around the land and what has CDA done, At that time I dont think it was under CDA's jurisdiction, but NOC was not required to build the property around the area, Pakistan unfortunately is a banana republic where laws dont get implemented and followed. even if it was illegal at the time why did nobody object after 20+ years.

SC seeks Imran's response on Bani Gala estate documents

ISLAMABAD: The Supreme Court gave on Thursday gave Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan one week to furnish a response on the documents related to his Bani Gala estate that have been submitted in the apex court.

On Wednesday, Mohammad Umar, a former Bara Kahu union council official, claimed in the Supreme Court that the no-objection certificate submitted in court by Imran related to his Bana Gala residence was never issued by the authority. However, the PTI denied the allegations.

Hearing the case regarding encroachments and environmental degradation in Bani Gala, Chief Justice of Pakistan Justice Mian Saqib Nisar observed that the court is more concerned with the public health aspect of the case.

He remarked further that they do not want hazardous water to be delivered to the public.

Addressing State Minister Tariq Fazal Chaudhry, who heads the Capital Administration and Development Division, Chief Justice Nisar inquired if the minister has reviewed the filtration of water in the locality.

The additional attorney general informed the court that they will make a film of the area through a drone and submit it in court.

Imran’s Bani Gala residence NOC and blueprint fake, says former union council official

During the hearing, Imran’s counsel denied the media reports regarding the PTI chief's Bani Gala residence having been constructed illegally, to which the chief justice responded that the counsel should deliver this denial outside the court.

The chief justice lamented that the documents were released to the media before they were submitted in court.

Earlier, as the proceedings began, the chief justice admonished Chaudhry for his last night's statement regarding the "apex court’s test".

CJP questions measures taken to tackle population explosion

At the hearing on Feb 22, following the court's earlier directions, Imran's counsel had submitted his Bani Gala estate's building plans in court.

Last year, the Capital Development Authority had informed the apex court that more than 100 structures in Bani Gala, including Imran's residence, are illegal.

The case is based on a suo motu notice which originated from Imran's petition seeking the court's intervention to stem illegal construction and environmental degradation in Bani Gala.

SC demands response from Imran over allegedly fake NOC

Imran.jpg

ISLAMABAD: The Supreme Court of Pakistan demanded a response from PTI chief Imran Khan within one week regarding the alleged fake No Objection Certificate for his Bani Gala land.

Proceedings were being conducted at the Supreme Court pertaining to the illegal construction on Bani Gala land during which the chief justice inquired whether Imran Khan had responded to the allegation that he had submitted a fake No Objection Certificate at the apex court.

“The response was given on media, we did not get it,” said Imran Kan’s attorney.

Stating that Imran Khan was being accused of submitting a fake No Objection Certificate, the chief justice demanded the cricketer-turned-politician submit his response within one week.

Chief Justice Mian Saqib Nisar scolded Minister of State for Capital Development and Authority (CAD), asking him to inform the court as to what procedures had been taken to ensure cleanliness of Rawal Dam.

“Are you here to test us?” said the chief justice to Dr Tariq Fazal Chaudhry.

Former secretary Union Council Bara Kahu, Muhammad Umar stated in a hearing of the apex court a day earlier that the NOC and blueprint of Imran Khan’s Bani Gala land were both fake.

He had further stated that the Union Council had not issued the No Objection Certificate to Imran Khan and other documents presented before the court were not issued by the local authority as well.

Former prime minister Nawaz Sharif had stated earlier during the day that he was consulting advisers and legal experts concerning recent reports that the PTI chairman had submitted fake NOC and blueprint of the Bani Gala land.

ARY Report

IK gets week-long time to submit reply on Bani Gala’s fake NOC

ISLAMABAD: Chief Justice of Pakistan (CJP) Justice Mian Saqib Nisar on Thursday gave a week-long time to PTI chief Imran Khan to submit his response over reports of fake no-objection certificate (NOC) making rounds on media pertaining to his Bani Gala residence.

A three-member bench, headed by the CJP, of Supreme Court was hearing a case with regard to illegal construction in Islamabad’s Bani Gala area when sought a reply from the PTI chief.

During the court proceedings today, the CJP remarked that the news reports pertaining to fake NOC and blueprints of Khan’s Bani Gala residence have been circulating in the media.

He then inquired Imran Khan’s lawyer Faisal Chaudhry whether the reports are true.

To which, Chaudhry said he didn’t go through the records yet.

Justice Nisar then directed him to submit a reply within a week on the matter.

A reply of former local government official drew the top court’s attention into the matter when he claimed the PTI chief had submitted bogus documents for construction of his residence in Bani Gala area of the federal capital.

Former secretary Union Council Bara Kahu Muhammad Umar said it in his reply to the top court over encroachments.

Moreover, Additional Attorney General (AAG) Nayyar Rizvi submitted a report in the apex court on Wednesday, stating that Khan’s NOC for the construction of his Bani Gala residence could not be verified.

However, the PTI chief denied the allegations and asserted that he had obtained an NOC for the construction of residence in Bani Gala.

Taking exception to Khan’s claims, Muhammad Umar, who was secretary of the Union Council n Sohan in 2003 when the document was issued, denied issuing any such document.

SC demands explanation for Bani Gala documents submitted in apex court

SC seeks Imran’s response to Bani Gala estate documents’ authenticity

ISLAMABAD: Chief Justice of Pakistan (CJP) Justice Mian Saqib Nisar remarked on Thursday that it is a crime to submit false documents in court.

He made these remarks while heading a three-member bench hearing a suo motu notice on dual nationalities of federal government employees.

As the hearing began, the Establishment Division secretary informed the court that 13 of 3,500 government officials possess dual nationalities.

The chief justice expressed surprise at the low number of dual nationality holders and remarked that they will investigate if anyone is has concealed their foreign nationality.

He also observed that it is not in Pakistan’s interest if persons with dual nationalities serve on important posts.

On January 17, the Supreme Court (SC) had summoned details of senior government officials and members of the judiciary having dual nationalities.

The chief justice had taken notice of the issue while hearing a separate case.

The apex court hearing another case, gave Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan one week to furnish a response on the documents related to his Bani Gala estate that have been submitted in the apex court.

On Wednesday, Mohammad Umar, a former Bara Kahu union council official, claimed in the Supreme Court that the no-objection certificate submitted in court by Imran related to his Bana Gala residence was never issued by the authority. However, the PTI denied the allegations.

The CJP while hearing the case regarding encroachments and environmental degradation in Bani Gala, observed that the court was more troubled with the public health aspect of the case. He asserted that they do not want the public to use and consume hazardous water.

Addressing Capital Administration and Development Division (CADD) State Minister Tariq Fazal Chaudhry, the CJP
asked the minister is he had assessed and surveyed water filtration in the locality.

The court was informed by the attorney general that a film will be made with the help of a drone and submitted to the court.

Further on in the hearing, Imran Khan’s counsel negated media reports of the PTI chief’s Bani Gala residence as an illegal construction. The CJP responded by directing the counsel to state this outside the court.

Nisar pointed out that the documents were released to the media before being submitted to the court.

Last year, the apex court was informed of over a hundred illegal structures, including the PTI chief’s residence in Bani Gala by the Capital Development Authority (CDA). On the February 22 hearing, Imran’s counsel in lieu of the court’s directions had submitted Bani Gala estate’s building plans.

Earlier on Wednesday, Additional Attorney General (AAG) Nayyar Rizvi while submitting a report in the SC said that he could not verify the no-objection certificate (NoC) submitted by the PTI chairman for the construction of his residence in the federal capital.

Here is the thing, I have already posted an article from Geo website and highlighted it in Bold, the main points, but this champion guy is too obsessed keeps on posting the same multiple articles, The onus is clearly on CDA, why did they not have a problem back in 1990's, and even now the properties are still being built around the area, but from PTI's point of view no NOC was required at the time, IK just voluntarily decided to get NOC approved. Even though this ex council is denying he signed the docs, why did he not take any action to stop the construction of the property if it was illegal?

Here is Pakistan today report..

SC gives Imran Khan week’s time to cough up Bani Gala documents

https://www.pakistantoday.com.pk/20...n-weeks-time-to-cough-up-bani-gala-documents/

Now here is the thing proven from multiple news sources, that Court is asking questions from imran khan about the validity of documents submitted by him in the court, and given him a time of 7 days for response, and CJP himself saying that submitting fake documents in the court is a crime, according to Law whoever submits fake documents in the court can get upto 7 years jail punishment.

Now i am not saying that Imran khan does not posses the valid documents, thats on court to decide, i just shared the news of hearings in SC today, rest is on court, and all must respect court's decision... period

.
AND WHAT IF Mohammad Umar, a former Bara Kahu union council official PROVIDED FAKE NOC..

. .
Just two questions, first why he used a current seal of UC Secretary, as he is Ex-Secterary?
Second how Imran get the approval of house map? someone at that time approved that isn't?

Current seal seems to be of UC Sohan and not Barakahu.

Perhaps now he is UC Sohan.
