Bangladesh court declares Jamaat-e-Islami illegal

DHAKA: Bangladesh's main Islamic party was banned from contesting next year's election when the high court ruled Thursday that Jamaat-e-Islami's charter breached the country's secular constitution.

"It is hereby declared illegal," said Moazzem Hossain, the chief judge hearing the case amid tight security outside the courthouse in Dhaka.

A lawyer for the Bangladeshi election commission, which oversees preparations for elections due next January, said the ruling meant Jamaat could not field candidates.

"As a party Jamaat's registration with the election commission is declared illegal, with the consequence that they cannot contest the election as a political party," Shahdeen Malik told.

"The party can still carry on with other political activities. If it amends its charter, to bring it in conformity with the constitution and reapplies for registration, it can be re-registered," Malik added.

There were fears ahead of the ruling that it could trigger fresh protests by Jamaat supporters in the politically volatile country, already reeling from violence over war crimes verdicts passed on Jamaat's top leadership.

Police and members of the elite Rapid Action Battalion were deployed outside the court in central Dhaka but there were no immediate reports of violence.

The ruling comes after a leading Sufi group, which practises Islamic mysticism, filed the public interest litigation in January 2009 seeking to scrap Jamaat's registration.

Secular protesters have long demanded that Jamaat be banned for its role in the 1971 war of independence, during which it opposed Bangladesh's breakaway from Pakistan.

Top Jamaat leaders are being tried for crimes during the war and four of them have been sentenced to death for murder, mass murder, rape and religious persecution.

Protests over the verdicts have sparked violence that has left at least 150 people dead during street clashes with security forces, Human Rights Watch said in a report released Thursday.

Jamaat says the trials are a sham aimed at eliminating the party, which is a key opposition force.

Bangladesh declares Jamaat illegal congratulations to Bangladesh for job well done.

A leading Sufi group, which practices Islamic mysticism, and dozens of others filed the public interest litigation in January 2009 seeking to scrap Jamaat's registration just days after a secular government took power.

A lawyer for the petitioner, Sheikh Rafiqul Islam, told AFP on Wednesday that Jamaat's charter violates the secular constitution as it calls for religion centric laws and discriminates against minorities and women.

With this decision Supreme court have just saved the nation from terrorist Once again congratulation to Bangladesh.

They really seem to be trying to become the country that Jinnah wanted Pakistan to be.

I have always said that INDIA and BD are natural allies:D

not really, before there were two parties, pro india and pro-extremist (against secularism) but now pro bangladeshi is high, so it is now bad news for both pro india and pro-extremist.

Well we both are in the process of the same buddy and the recent developments on the Enclave exchange accord depicts the same and all such differences will be solved in the near future....

BTW I don't have much knowledge on the internal politics of Bangladesh, can you please tell me who is who??????
 
A step in right direction as Jamat is an incubator of extremists and terrorist. The role of Pakistan played against Bangladesh is not any different than what it played against Pakistan and Jinnah, however we have welcomed these traitors as our hero.

Pakistan must prove its self worth by reciprocating the same in Pakistan, it would solve atleast 80% of religious blackmailing and terrorism.

and if Pakistani courts declares all secular parties illegal


then chapionis of humanity will start bashing Pakistan


recently no implementation of article 62/63 in general elections
