But that will be out of Judge's jurisdiction since he will be explicitly looking at the messages sent to her from that phone, if any and their nature. I don't think rest of the record will be archived and made part of the analysis for different purpose. Though i am not sure about it. Depends upon the nature of the case since I believe it will be whole new different case with different purpose.
