Lalit Modi case determined with appropriate rules: UK

The UK today said it had acted "appropriately" and in accordance with rules when issuing travel documents to scam-tainted former IPL chairman Lalit Modi.

"We do not routinely comment on the detail of individual cases. This case was determined in accordance with the appropriate rules," a UK Home Office spokesperson said.

The department also confirmed to PTI that the UK's Permanent Secretary is "satisfied" that Sarah Rapson, the Director-General of UK visas and immigration, acted "appropriately and professionally in handling this case".

Rapson was the senior official who received correspondence from Indian-origin MP Keith Vaz in relation to expediting paperwork for London-based Modi to be able to travel to Portugal in June last year.

The Indian Premier League (IPL) founder is at the heart of a controversy which has engulfed External Affairs Minister Sushma Swaraj over accusations that she put diplomatic pressure on UK authorities to secure travel papers for Modi to visit Portugal, purportedly for his wife's cancer treatment.

Modi had come to London in 2010 amid claims that the IPL cricket tournament was embroiled in alleged match-fixing and illegal betting. His Indian passport was later revoked, leaving him grounded in the UK.

A series of 'Sunday Times' reports have alleged impropriety on the part of Vaz, who also made a reference to Swaraj in one of his UK Home Office emails.

Kathryn Hudson, Britain's Parliamentary Commissioner for Standards, yesterday confirmed that she will not be investigating Vaz over the issue.

"The Commissioner received a complaint (against Keith Vaz) last week, but has decided not to investigate into it," a spokesperson for the Parliamentary Commissioner for Standards had said.

However, the row continues to brew in India as the Opposition demands Swaraj's resignation.

After the reports surfaced, 63-year-old Swaraj said in a series of tweets that she had taken a "humanitarian view" and conveyed to the British High Commissioner that they should examine Modi's request as per their rules and "if the British government chooses to give travel documents to Lalit Modi -- that will not spoil our bilateral relations".

Modi has always denied any wrongdoing and says he left India for Britain because of death threats.

Shortly after he received his UK travel documents in 2014 after a lengthy legal battle with the UK Home Office, he had described Vaz as a "superstar".

Here its not about UPA or NDA but seems about extradition procedures between India and Britian because Lalit Modi has left India in 2010 .


The ED says that there is a blue-corner notice that has been issued against Lalit Modi. However Lalit Modi's advocate denies that such a notice has been issued. A blue-corner notice is generally a notice for inquiry. It is issued to verify an individual's identity or to locate a person who is missing. The notice is basically sent to the Interpol and in turn the agency issuing such a notice can seek the extradition of the persons. However a red-corner notice is even more serious.

If the ED manages to have the red-corner notice issued, then the person can be arrested and extradited. The ED feels that the case has been pending since a long time now and for them to question Lalit Modi, they would need to first issue a red-corner notice against him.

So if the ED issues red corner notice against him , Will he be extradited from Britian ?

I think here its more about the India-Britian agreements related to extradition because 1700 Cr are there. Where is that money ?

Pranab Mukherjee ordered ED probe against me as revenge for Tharoor sacking, claims Lalit Modi | Zee News
Former IPL chief Lalit Modi has alleged that it was Pranab Mukherjee who had ordered the Enforcement Directorate probe against him in connection with his IPL-related and personal financial transactions.

Mukherjee was the finance minister in the UPA-2 government when the ED probe against Lalit Modi was initiated in 2010.

Soon after the probe was ordered, Lalit Modi left India and has been living in the United Kingdom since.

The Times of India reported on Friday citing a document that Lalit Modi believed the probe was ordered against him by Mukherjee for revealing the role of former Union minister Shashi Tharoor in the Kochi IPL franchise.

Tharoor was later sacked after the controversy blew up.

Just days ago, the ex-IPL boss had claimed that three former Congress ministers – Shashi Tharoor, P Chidambaram and Salman Khurshid – had tried to scuttle his chances of living in the UK. He had also, reportedly, blamed Chidambaram – the then home minister – for persecuting him for the same reason.

On November 26, 2010, following his move from India to Britain that year, Scotland Yard was asked by RAY about its threat perceptions in respect of Modi. The Yard replied: "We have no knowledge of any threat to Mr Modi."

On Thursday, the official response was: "We do not discuss matters of security or the identity of individuals involved."

However, a source at Scotland Yard on condition of anonymity affirmed: "Nothing has changed." In other words, the Yard still has no knowledge of any threat to Modi.

In response to notices served on him by investigating agencies in India to make himself available for questioning, Modi has claimed his life would be in danger if he returned to India. But he does not appear to have informed the Yard about such threats or sought its protection.

Since Sunday, Modi has contributed to a political storm in India by dragging its External Affairs Minister Sushma Swaraj and Chief Minister of Rajasthan Vasundhara Raje into his efforts to obtain travel papers from the British government and residence in this country respectively.

Earlier, under the Congress-led Indian government, his passport was confiscated and the Indian government in a diplomatic note to its British counterpart sought his deportation back to India, where he has been served show-cause notices in at least 15 cases of alleged economic or criminal offences.

Modi is now reportedly holidaying in Montenegro.

Since Lalit Modi spoke up and clarified that Sunanda was indeed the front, Tharoor had to resign as Minister. In exchange for his resignation, Tharoor asked that Lalit Modi too be made to quite IPL and that is how this whole which hunt started.

Today Tharoor is in the dock for killing his Wife and Lalit Modi is making a come back proving that there is Justice in this world.

The congress just cannot stand to see their evil work undone. Its just sick.

The ED is in the process of serving final penalty notices in 16 alleged forex violation cases amounting to an estimated Rs 1,700 crore against former IPL Chairman Lalit Modi and others as part of its wide-ranging probe in the alleged financial irregularities in various editions of the T-20 cricket extravaganza.


High-level Enforcement Directorate sources said apart from these cases, two other instances of suspected contravention of foreign exchange laws and hawala transactions are also being investigated by the central probe agency and these include investigations on the role of Modi.

Investigation in a third case of money laundering against the former cricket czar, sources said, is also "underway" which is related to the alleged misappropriation of funds in allotment of cricket media rights by BCCI in 2009.

"About 16 cases being probed under the Foreign Exchange Management Act (FEMA) are in the final stages of adjudication, which means final orders for penalty will be served in the coming months against the accused which includes all the important functionaries of the IPL-BCCI including Modi.

"The cases amount to violations of an estimated Rs 1,600 crore and the the maximum penalty that can be slapped on the accused could be three times of this amount," a source said.

The agency, in February, had slapped a similar Rs 425 crore show-cause notice against Modi, former BCCI boss Srinivasan, the IPL, private multimedia firms for alleged contravention of forex laws in awarding a cricketing media rights contract in 2009.

ED set to slap penalty notices on Lalit Modi over forex violations
After the adjudication process is completed, the ED may issue final orders for payment of penalty but no decision on this has been taken so far, sources said. A penalty worth three times the amount involved could be ordered by the adjudicating authority, which would then have to be realised by the ED, said an agency source.

“On completion of the adjudication process, the ED is likely to issue final orders for penalty in the coming months against those facing the probe, including Modi,” said the source.

“UK authorities, the country where Modi is currently based at, treats FEMA (Foreign Exchange Management Act) as a civil law. And they share information only in criminal cases,” said a top ED officer, indicating that not enough information was forthcoming from that country.

Other than Modi, most parties, including Board of Control for Cricket in India (BCCI) office-bearers involved in conducting the IPL, had recorded their statements, ED sources said.

“A probe was initiated in 2010 on various counts of irregularities that came to light. One of the issues involves BCCI operating a bank account in South Africa without requisite permissions from the Reserve Bank of India (RBI),” said an ED officer, requesting anonymity.

As per FEMA rules, to open and operate an account abroad, an Indian person or entity needs to seek the RBI’s permission.

Sources said the BCCI transferred over Rs 200 crore worth of foreign exchange to that account through Cricket South Africa, again in contravention of FEMA provisions. The ED found that the BCCI spent money from that account for IPL season two.

Also on the ED radar are FEMA violations whereby the BCCI allegedly received ‘performance deposits’ from foreign companies.

The probe revealed the board had not taken permission from the RBI to accept such deposits from persons residing out of India, ED officials said.
