Aitizaz to start Lawyers' protest again

I wanted Musharraf to do these things since 2006, but i dont know why is he so reluctant to arrest these rioters and put them in jail for a long time.

He just arrests them cautiously and then the pathetic political parties along with our immature media, starts crying like babies.
Our nation deserves a dictator, which they are calling him these days anyway,.. but actually they really needed the dictator side of Musharraf which he hasnt shown since he came into power.
And yes he really needs to show the Iron-Hand to people like Aitezaz, and all his puppet extreme followers.

Yes since Pakistan came to formation,, every dictator who came into power has shown his dictatorship, i havent seen any of those era's , but certainly reading the facts and stories and the situation in which Pakistan is in now, is enough to tell how cruel and unpatriotic they were.

Creating disturbance wherever possible, burning buses, banks, petrol stations, other important buildings,,, in the name of some little and unneccessary matter,,, does not come in the category of freedom.
Its not freedom, its taking law and order in ur hands.

90% of protests taking place in our country are either based on (1) lack of clearity abt an issue due to wrong image created by media,,, or (2) political parties driven agenda transferred to a specific lobby, these days,, that lobby are the lawyers.

These so called "civil society" and "lawyers", are not genuine people, they have their agendas, and therefore they do not care wat is harming their country and wat isnt. No one can/should be allowed to create disturbance in the name of freedom , when its harming the image of the country and espically when its forcing people to believe in something which is completely different.

The government has given so much breathing space to all these protesters, and yet they are ready to call a person a dictator on the basis of a single occasion( which is also debatable). This is the level of the minds of some of our people.

Garlanded by the lawyers and civil society members after release, Kurd said: “Lawyers community will continue its struggle and the day is not too far when the people will have the right to live with honour and respect in this country.”

Judges’ detention: Aitzaz to file FIR against Musharraf

LAHORE, March 3: President of the Supreme Court Bar Association (SCBA) Aitzaz Ahsan has said he will file an FIR against President Pervez Musharraf and officials concerned for ‘illegally confining’ deposed Chief Justice Iftikhar Mohammad Chaudhry and eight other Supreme Court judges.

Addressing a press conference at his residence on Monday, Mr Ahsan said the Senate had admitted that the deposed chief justice was being detained contrary to previous government claims that he was a ‘free man’.

He said he would go to Islamabad after visiting Karachi and Sukkur to lodge the FIR against all people responsible, including the Inspector-General of Police, the chief commissioner of Islamabad, the home secretary, the interior minister, former prime minister Shaukat Aziz, caretaker prime minister Mohammadmian Soomro and President Musharraf.

He said the FIR would be lodged under sections 344, 348, 506 and other relevant laws. “We know Gen (retd) Musharraf has immunity till he purports to hold the office of the president. But we will not let him go scot-free,” he said.

Mr Ahsan said Justice Sardar Raza Khan, Justice Shakirullah Jan, Jutice Khalilur Rehman Ramday, Justice Falak Sher and Justice Raja Fayyaz were still confined and had not been allowed to go to offer Eid prayers.

The lawyers would also file civil suits for the recovery of damages worth billions of rupees, which would be recovered from their personal properties, he said.

Terming the act of detaining of more than 60 judges shameful, he said it had no parallel in history.

Dispelling the perception that the lawyers’ long march had been cancelled, he said if it was necessary, not only the deposed judges but retired judges, including former chief justice Saeeduz Zaman Siddiqui, Justice Nasir Aslam Zahid, Justice Fakharuddin G. Ibrahim, Justice Mahmood Qazi, Justice Khalilur Rehman Khan, Justice Rafique Tarar, Justice Zia Mahmood Mirza, Justice Karamat Nazir Bhandari and Justice A.S. Salam, would participate in the long march.

“Earlier, we had just one judge (on our side) … but this time around we have 45 judges and thousands of lawyers to march on to Islamabad. If they restrained one lawyer, thousands would be ready to replace him,” he said.

According to him, the arrests would not matter because ordinary people would also support the lawyers.

He said lawyers would give a fresh protest date if the judges who could be restored continued to suffer. He, however, said the lawyers did not want any confrontation with parliament because they believed in strong institutions.

He said he would make it clear to parliamentarians that lawyers wanted to become their strength but “we will oppose anyone who would not restore the judges”.

He said the lawyers would observe a ‘black flag day’ from March 9. Mr Aitzaz said arrangements were being made so that the deposed chief justice could address all bar associations simultaneously on March 10 and on March 13, lawyers would boycott judges who took oath under the Provisional Constitution Order and start staging rallies across the country.

Stressing the need for independent judiciary and media, he said that the country could never be truly free without it, adding that lawyers would wage a tough war against the Pemra Ordinance if the government tried to muzzle the media.

Mr Ahsan said he was aware that past parliaments had validated measures taken by dictators and it would still be in its right if it validated the Nov 3 emergency order, which in essence was martial law.

When asked if Gen (retd) Musharraf could be tried under Article 6 of the Constitution, he said he could be impeached for abrogating the constitution and illegally removing and detaining over 60 judges. About the fate of the PCO judges, Mr Ahsan said the Nov 3 order of the seven-member Supreme Court bench was legal, constitutional and binding.

He said that anybody who took oath under the PCO was not a judge because the SC bench had declared it illegal, unconstitutional and unlawful.

When asked why had the bar failed to completely boycott the PCO judges, he said the lawyers were appearing before them in public interest, adding that they had faced severe economic hardships to keep their movement alive. When asked how would he respond to political parties ‘willing to work with Gen (retd) Musharraf’, Mr Ahsan said these parties knew very well that independence of parliament could not be achieved without an independent judiciary.

He said: “If they tried to go ahead and severed one arm, they would be making a big mistake because you just cannot build a parliament on the debris of judicial structure.” He said the SCBA was ready to play a role for bringing about a new social contract to ensure an independent judiciary and a parliament in total control of the state affairs.

He said the Supreme Court judges, who were under an illegal oath, could not validate the Nov 3 emergency because they themselves had benefited from the step. “Nobody could be a judge of his own cause,” he said.

He said the fate of the judges, who took oath under the PCO and under the amended constitution, would be decided by the restored Supreme Court in accordance with principles laid down in the famous judges’ case.

Waseem Shamsi adds from Sukkur: Aitzaz Ahsan has asked parliamentarians to immediately reinstate ‘bold and honest’ judges otherwise the lawyers would take action.

He said that the lawyers were giving “time to parliament to take positive steps for safeguarding the judiciary”.

Mr Ahsan, who arrived here on Monday evening from Lahore, was addressing a press conference at a local hotel.

He said there was no need of for a two-third majority in parliament for a constitutional amendment to reinstate the deposed judges, because “this can be done by merely an executive order”.

LAHORE: Pakistan Lawyer's Forum on Tuesday decided to inform heads of all the political parties that the incoming Parliament could restore the deposed judges with simple majority.

The PLF reached the decision in this aspect in a meeting held in the Kiyani Hall of the Lahore High Court Bar Association building.

PLF President AK Dogar chaired the moot. The forum reached the conclusion that as the November 3, 2007, Proclamation of Emergency, the Oath of Office (Judges) Order and the Provisional Constitution Order (PCO), of the same date have not yet been validated by the incoming Parliament, therefore, these unconstitutional orders issued by the then Chief of the Army Staff do not form a part of the Constitution of this country.

"It is, therefore, suggested and advised by the Pakistan Lawyers' Forum that the incoming Parliament, which commends comfortable simple majority can enact a legislative measure entitled Judges Restoration Act 1 of 2008," the meeting observed.

The meeting said this Act of the Parliament should take effect through the Council of Ministers headed by the prime minister, who is the chief executive of the country and a notification could be issued by the Ministry of Law and Justice and be sent for formal signatures of the President of Pakistan who is bound under article 48(1) to affix his signatures on the said notification.

Karachi- A movement of equal vigour will be launched against the new parliament if it fails to get the deposed Judges reinstated, the the pre-November 3 judiciary restored, and the media freed, declared President, Supreme Court Bar Association (SCBA), Aitzaz Ahsan, addressing a welcome reception that greeted him on his arrival at the Quaid-e-Azam International Airport on Tuesday evening. Without a powerful judiciary, said Ahsan, no elected government could rule for long.

The welcome reception at the airport was arranged by the Karachi Bar Association (KBA) and

President, KBA, Mehmood-ul-Hasan, Secretary-General, KBA, Naeem Qureshi, and the President, Sindh High Court Bar Association (SHCBA) Rasheed Razvi were among others present there.

This was his first visit to Karachi since his detention.

Aitzaz arrived in the city after visiting Garhi Khuda Bux to offer Fateha at slain PPP leader Benazir Bhutto’s grave. He flew in from Sukkur on flight PK-537 and was accorded a warm welcome by those present.

The lawyers present at the Karachi international airport were shouting slogans against President Pervez Musharraf and carrying banners and placards inscribed with slogans such as, “Muk Gaya Tera Show Musharraf” (Your show is over, Musharraf).

He warned the newly-elected government that the lawyers had only postponed their movement for the independence of the judiciary and hadn’t cancelled it, emphasising that the lawyers would undertake a long march to the parliament to force the newly-elected government to march back home if they not fulfill the demands of the lawyers. Atop the list of demands, said Aitzaz, was the reinstatement of the CJP and other Judges of the superior courts.

He further said, “We have given time to the new government, but will not give more time. As soon as they sit in the assembly they will have to take a decision on the rule of law, independence of judiciary and reinstatement of Judges who were sacked under the PCO.

“There is no country in the world where a parliament is set up at the cost of the judiciary,” he said and argued that neither could stability prevail in national organisations nor could public issues be resolved without the independence of the judiciary.

He feared that the children of deposed Chief Justice of Pakistan might be kidnapped as he foresees that a conspiracy is being hatched by allowing them to go to school.

Regarding his visit to Karachi, he said that he had come to consult the city’s legal community for the future course of action to be taken in terms of the ongoing movement of lawyers.

He also informed that an application to register an FIR against the illegal detention of the deposed CJP has been filed with the concerned authorities.

A powerful judiciary is necessary for a powerful elected parliament, he maintained and added that throughout his by road visit to Garhi Khuda Bux, he witnessed people shouting slogans in favour of Bhutto, saying ‘ Jeeyay Bhutto.’ He said that they were asking him to not leave Chaudhry Iftikhar in isolation.

Aitzaz said that he salutes the lawyers of Karachi for their continuous struggle for the independence of the judiciary.

After addressing the welcome gathering, he left for a friends residence. He plans to leave for Islamabad on Wednesday (today) evening after addressing the Sindh High Court Bar Association (SHCBA) and Karachi Bar Association (KBA).

The security for Aitzaz’s arrival was tight, with a large number of law-enforcement agencies taking position at the airport area. While the entire arrival portion was cordoned off by the law-enforcement agencies, they were even deployed outside the departure section.

KARACHI: Supreme Court Bar Association (SCBA) president, Aitzaz Ahsan has said that the lawyers would not give long time to the new parliament for the reinstatement of deposed judges.

Talking to newsmen on his arrival from Sukkur here, Aitzaz Ahsan said that the parliament could not stand for long on the debris of the judiciary and added that the lawyers’ long march has not be cancelled, but postponed for some time. He said that a black flag week slated March 9-16 would be observed, when black flags would be hoisted on the Bar Rooms and the women lawyers would be wearing black ‘dopatta’. He said that he has come to Karachi for making the lawyers’ movement more effective.

Sources said that SCBA president would also be meeting the Pakistan People’s Party (PPP) Co-Chairman, Asif Ali Zardari. However, no PPP leader was present on the occasion of his arrival at the airport. The legal community, civil society and political activists welcomed Aitzaz on his arrival in tightened security at the airport.

ONE ,thing is sure which that pakistan isnt ready for any kind of democracy till now! and it will be very good that DEMOCRACY shouldbe taught as a primary subject in schools , in MADARSAs and shouldbe waited around 10 years to get any kind of results.

there is a situation now in pakistan, where majority of the population doesnt understand a bit of DEMOCRACY because, they dont have any information,any knowledge at all . the only thing pakistani commn people know about democracy is ELECTIONS . its very ironic that elections are the only processes which is the source to bring a bunch of selected people into stage of power, but unfortunatly in pakistan this process is being not fare because every time , there is election, every time pakistani people elect wrong people and because of tht reason ! every time pakistan gets same sort of rulling class i , mean the, crouptors , the looters and then they do whatever they want.

AND to stop thier crouption, thier illegal activities , their ultimate and unlimited use of power, ARMY had to interfer every time, and just because of that very reason each time ARMY gets warmly wellcomed by genral people and dejected politicians and greedy berucrats.

ON the other hand , ARMY having no experince of goverment ! gets in troubled evry time because of thier relliance on these crroupt politicians , berucrats and outside powers. so therefore AFTER some period of time, each time in the history of pakistan, ARMY RULE was called unjustifiyd and NOBODY give any credit to army for its services at the time of crissis AND in the time when there is no solutions left, all this kept happning time and time & again and again , it seems there is no end to it.


SO, i guss pakistan has reached a point, where there is heavy need to devolp pakistan a truley democratic country, and there for it is very importatant that genral people of pakistan shouldbe trained and educated to get real democracy and for the timebieng its good to wait for some time to get better results , & if itsnt done PAKISTAN WILL KEEP LOSSING ITS MONEY, ITS RESOURSES AND ITS IMAGE.

^^I agree with you on that power cycle process in which army is forced to come again and again.
But Pakistani people cannot be trained until someone dosent use an iron-hand , otherwise it'll' take them another 100 years to really understand wat is democracy and wat is national-interest.

Musharraf hasnt used any Iron-Hand so far, which these people are taking advantage of,
1st they force him to take some action against them, and when he acts, media starts crying like dumbo's, as if action is being taken against innocent people. Hence, creating bad image of Musharraf and government.

Iron_Hand is not being used on every common man,, but on those elements in Pakistan who want to create destabilization of the country and want to harm the country in every single way they can, and until now this role is being played by political parties who are american puppets in reality.

Wat our public needs to understand that our Government should/cannot allow such people to do watever they want in the name of freedom. This is not freedom, but a route to further divide Pakistan.

You claim that Aitizaz Ahsan stands for democracy and democratic ideals. Fine I will take you up on your claim but can you tell me if he is such a democrat then why did he vote for Benazir to be the Chairperson for life of the PPP? Why is he trying to restore the same judges who previously took oath on the PCO? Honestly I would of supported the lawyers movement but I think they went a bit overboard and also the language they used in describing the Armed Forces of Pakistan. Thier struggle was for the restoration of the Chief Justice. Now when he was restored why did they still carry on their protest. Even when President Musharraf was declared as the legal President by the Supreme Court in October they protested. If the believe that the Judiciary is right they should of done things in a peaceful matter. But no they went out into the streets and protested disturbing the lives of the people. Today the lawyers are supporting Nawaz I ask them wasn't it Nawaz who sent his goons to strom the Supreme Court and beat up the Justices. The fact is everyone is in this struggle for their own selfish gains.

Karachi- Regarding the three-day-march plan, Aitzaz said lawyers from Sindh and Balochistan would travel to Multan under the leadership of the deposed judges on the first day. On the second day, the caravan of lawyers would move towards Lahore and on the third day they would proceed towards Islamabad.

“Lawyers will be moving towards Islamabad from north, west, south and east and they would remain there till their objectives are achieved,” he said, adding, “The lawyers have pledged to give an independent judiciary and sovereign parliament to the coming generations.”

Nevertheless, he linked the plan with consultations with Bar councils and associations.

Aitzaz also said that the March 9 long march call has been postponed as lawyers wanted to allow the parliament some time and give them the opportunity to undo the illegal November 3 amendments made by Musharraf.

He, however, made it clear that this relaxation was not for months but for weeks. He also hinted at launching a strong agitation movement against President Musharraf throughout the country.

Complete strike on 10th: On the occasion, Aitzaz Ahsan also announced a complete strike on March 10 in connection with “black flag week,” which is to be observed to denounce President Musharraf’s action against the judiciary.

“March 9 (2007) was the blackest day in the history of the country when an army chief along with four other generals summoned the chief justice of Pakistan and illegally restrained him from performing his constitutional duties,” he stated.

He informed the lawyers that traders were also willing to support them in their struggle for the restoration of judiciary and urged the lawyers to hoist black flags and wear black armbands during the week.

He also criticised those lawyers who did not support the cause of legal fraternity and were appearing in the courts during the strike calls of lawyers, saying: “I asked such big names in the legal fraternity to consider, for God’s sake, the four-month detention of Justice Iftikhar and his family and support the lawyers’ cause”. —JK

I, THINK mr, aitazaz has reached to a point ,where he should be sent to perform UMMARAH by the use of IRON HAND.

If Pakistani people cannot reject Aitezaz Ahsan's words and his calls and his marching in streets,,, then they dont deserve an honest person to lead the country, i m just hoping Musharraf gives him a solid dose!
