A very LOCAL Government Bill 2013

Local Body Bill 2013 – Deconstructed
Out of two shameless events on day of 19th August 2013, one was the approval of the local government Bill 2013.Other is written here (He is not Shehbaz Sharif …Juggleries of Political Businessmen | The Last Blog)
People of Pakistan are usually unaware of the government and its working. Ordinances, bills and constitution are drafted in language that is not a language at all. Somehow they look legal talk law and decide the faith of the nation.
Since 2008, I haven’t gone through any ordinance that has been crafted with care. Many have been passed but they all are a bunch of words and phrases that I am sure most of the parliamentarians would fail to describe.
The question that I pose is, what sort of a machinery government of Sindh and the people of Pakistan are working with. Why English is the official language of government of Pakistan when they fail to draft a single error free letter.
What about the legal experts, constitutional experts, civil services and bureaucrats. There carelessness and incompetency is avid in every government document that I came across, released by any government across Pakistan.
Firstly I thought that it is sort of a norm, or the governmental dialect or for that matter the bills and ordinances are written in such way that they want to hide the rights of the common man given in the bills.
Going through the Local Government Bill 2013 is an experience beyond explanation. Such legal documents handled with such apathy depict the dedication of our MPA’s and MNA’s to the noble cause of running this country. It was confusing to know that the government of SIND is still Government of SINDH, but federation and Islamabad, (based on personal experience) doesn’t recognizes SINDH anymore, since the SINDH house is Islamabad is the SIND house andSINDH technical Board is SIND technical board. I wonder why it is still SIND in federation and most of its websites and SINDH in Local Government Bill 2013.
Secondly, government of SIND or SINDH should now know that there is thing called spell check in a software called Microsoft Word, which would be available in a Monitor that looks like TV back home in Goth Allah Deno. And that they now can let go off type writers and clean of the posts of Steno-typist, which has been the most sellable and lucrative post in the government of Sindh. I mean any one who is a bit aware of governments in sindh knows that fact that steno typist is the first job that any government sells.
People’s Local Government Act 1972 – Local Government Bill 2013.
It was such a major disappointment, in this time of great Pakistan depression to know that the people’s Local Government Act 1972 and Local Government Bill 2013 are Xerox copies of one and other. If I say it in the language ofSindh then People’s Local Government Act 1972 is the father of Local Government Bill 2013, which has just taken its Gaddi. It’s like watching Pir Sahib Pagaro recent taking over the Gaddi or Sain Pir Mardan Shah Pagaro, the Ex Pir Pagaro.
I came to know after comparing both the bills that nothing has changed much from 1972 to 2013 for the people of Sindh, apart from what is necessary for the rulers of Sindh.
It was very uplifting to see that the needs of city government, the needs of multiplied populations, sanitary systems and other civic needs are almost the same as they were in 1972, because the bill doesn’t mention much of the changes on the functionality and new requirements of the urban areas of Sindh. Despite the fact that in function, Hyderabad, nawabshah and mir pur are now more urban then before.
Glossary and definitions are also much fun to read, as even the order from 1972 to 2013 hasn’t been changed.
Firstly I would like to mention the bizarre definitions that I came across in the Local Government Bill 2013, these are similar and copied from the People’s Local Government ACT 1972.
“Dairy” includes any farm, cattle shed, cow house, milk shop, milk store or other place from where milk products are supplied for sale;
(was valid in 1972, This should make all super stores and all bakeries into dairies, because both bakeries and superstores are not defined in the law)
“Dwelling house” means any building used substantially for human habitation;
(a known legal term looks like crap in the local body ordnance)
Erect or re-erect a building’ means the construction of a new building and includes such material alternations of a building as enlargement of any wall, verandah
(I don’t know … Lets go and sit on a newly erected building for explanation)
“Election Commission” means the Election Commission of Pakistan
(Thanks they defined it in this law, otherwise I thought that was a national morgue)
Now
“Ward” means a basic electoral unit under this Act;
And
“Electoral unit’ means a portion of a local area from which one or more than one members shall be elected;
(So are these same or different, why are they mentioned separately, no clue to know. )
As for the so called elected local government system
Chief Executive” means the Municipal Commissioner, Chief Municipal Officer Chief Officer, Town Officer or Secretary,as the case may be;
And
“Chief Officer” means the Officer In charge of the Administration of a District Council;
AS we know, officers, commissioners and secretaries are unelected bureaucrats, this need further explanation.
Now I don’t find any definition of Chairman in the Law but
Mayor means the Mayor of a Corporation
And
Metropolitan Corporation includes Metropolitan Corporation constituted under this Act or any other area declared as such by the Government;
Then
Municipal Commissioner” means the Officer In charge of the Administration of a Corporation;
So if commissioner is in charge of administration of Corporation then what will the Mayor be in charge of.
And again
“Chief Municipal Officer” means the Officer In charge of the Administration of a Municipal Committee;
When chief municipal officer would be the in charge of administration of Municipal or Metropolitan committee, then what would the CHAIRMAN and VICE CHAIRMAN do? What is the purpose of Mayor?
There is a lot more that is practically fraudulent in the Local Government Bill 2013. Why the local government Bill 2013, wastes so much time energy and effort on defining the role of the election commission, almost ten pages are written on the task of the election commission. Election commission is an Autonomous body with highly regarded legal experts in it. It should have the modus operandi to arrange and conduct elections of any sort and form in any part of Pakistan. Instead people telling them what to do.
I have met a lot of members of Sindh Assembly, most OF these local politicians like Speaker Siraj Durrani and Nisar Khoro are qualified people with the understanding to fix all what’s written above, but I think they lack the will to do so.
The local Government Bill 2013 is just an eye wash that would not devolve the power to the people but would give a structure that would curtail the devolution of power and would keep it in the in the right hands, that is the ruling elite.
