Islamabad/New Delhi: Despite best efforts from the Indian establishment, the mission to seek justice for 26/11 Mumbai attacks appear to be headed for nowhere due to Pakistan’s belligerent stand.

As per a media report, Wednesday, the Pakistan government has formally informed India that evidence provided by New Delhi in the 2008 Mumbai terror attacks case is not admissible in a Pakistani court as defence lawyers were not allowed to cross-examine Indian officials.

The report claimed that Pakistan's Interior Ministry has informed the Indian government that the evidence is not admissible in the trial of seven Pakistani suspects, including Lashkar-e-Toiba commander Zakiur Rehman Lakhvi, since defence lawyers were not allowed to cross-examine Indian officials when a Pakistani judicial commission visited Mumbai in March.



As per the Pakistani newspaper The Express Tribune, Pak Interior Ministry has sent a letter to the Indian government citing the ruling of a Rawalpindi-based anti-terrorism court and said cross-examination of key Indian officials is needed to make the evidence admissible in Pakistan.

During a hearing on July 28, the anti-terrorism court did not record the statement of two Pakistani investigators who were scheduled to testify about the evidence provided by India.

The judge ruled that since the evidence gathered by the Pakistani judicial commission in India had not been made part of the case, the testimony regarding the Indian evidence too should not be recorded.

The evidence provided by the Indian authorities includes the confessional statement of Ajmal Kasab, the lone surviving terrorist, a CD with intercepts of conversations between the attackers in Mumbai and their handlers in Pakistan, autopsy and medical reports of the dead and injured and the statements of four Indian officials.

The Pakistani judicial commission had interviewed these four officials during the visit the Mumbai. However, no cross-examination was allowed under an agreement between India and Pakistan.

Sources privy to the investigations by the Federal Investigation Agency told The Express Tribune that the Interior Ministry had made it clear to India that the evidence would not have any legal value in Pakistan if the Indian officials could not be cross-examined by lawyers representing the seven accused facing trial in Pakistan.

On July 17, the judge of the anti-terrorism court accepted Lakhvi's plea and declared the findings of the judicial commission "null and void".

The accused had challenged the legal value of the report of the judicial commission as their lawyers were not allowed to cross-examine Indian officials who provided evidence against them.

The seven suspects have been charged with planning, financing and executing the terror attacks in Mumbai that killed 166 people in November 2008.

Their trial has been hit by countless delays and the judge has been changed five times.

Buddy if terrorist attack happens in India and people are killed, world especially west has sympathy for India while if the same thing happens in Pakistan world thinks they deserved it. Sorry to say but this is the sad state of mind especially in west.

This sympathy and apathy of west, for same incident in both countries, is what is making the difference and its your media's duty to change the views of others as it directly affects the image and growth of the country.

Think rationally rather than emotionally.
 
India tried its best and failed. If they are not letting us cross examine, they have something to hide. And its only a media stunt to keep pressure and play the victim card. After all, this has always been India's modus operandi to keep the issues between two countries at bay. They call this success of their diplomacy. So let them be happy.
 
Jo bhi ho. If pakistan suffers for their acts in India for no matter what reason, maybe kashmir or any other thing, its good for India. Aisi galti ki ek baar saza di to kya fayda. Saalon tak tadpaenge is incident ke liye. Pakistan is and will be in deep deep **** economically and diplomatically until they get Indian support. So its on them to decide. Where they want their future to head. Decision is theirs.

Saalon tak tadpaenge is incident ke liye. Pakistan is and will be in deep deep **** economically and diplomatically until they get Indian support. So its on them to decide. Where they want their future to head. Decision is theirs.

They should put an end to this sham called inquiry and court case and should carry on with what they do best that is continue being a safe haven for all the world's most wanted's.

BS!! what western support you received after Bhopal plant blast in which nearly 20,000 people killed nobody cares about Indian lives its just business.

As this trend is actually came from West where loss of lives are used as a diplomatic propaganda. Indeed, West don't really cares of human life, even not of india, its just a business for them. They kill sailors then offer sympathy and apology thats how they works. Don't expect to much from them.
As far as our media concerned , its really kind of disappointment that they prefer their income over their responsibilty.

Not even in my dreams, it was clear the day ISI replaced Kasabs father with ISI agent.

GOP has no control over PA and ISI. They even go to the extent of hiding info from their government.

Pakistan fully deserve the title safe heaven for terrorist.
